 1        AN ACT in relation to vehicles.

 2        Be it enacted by the People of  the  State  of  Illinois,
 3    represented in the General Assembly:

 4        Section  5.  The  State  Finance Act is amended by adding
 5    Section 5.552 as follows:

 6        (30 ILCS 105/5.552 new)
 7        Sec. 5.552.  Lewis and Clark Bicentennial Fund.

 8        Section 10.  The Illinois  Vehicle  Code  is  amended  by
 9    adding Section 3-653 as follows:

11        Sec. 3-653.  Lewis and Clark Bicentennial license plates.
12        (a)  In  addition to any other special license plate, the
13    Secretary,  upon  receipt  of   all   applicable   fees   and
14    applications  made in the form prescribed by the Secretary of
15    State, may issue special registration  plates  designated  as
16    Lewis  and  Clark Bicentennial license plates to residents of
17    Illinois. The special plate issued under this  Section  shall
18    be  affixed only to passenger vehicles of the first division,
19    motor vehicles of the second division weighing not more  than
20    8,000 pounds, and recreational vehicles as defined by Section
21    1-169  of  this  Code. Plates issued under this Section shall
22    expire  according  to  the  staggered  multi-year   procedure
23    established by Section 3-414.1 of this Code.
24        (b)  The   Secretary  of  State  shall  confer  with  the
25    Governor's Illinois Lewis and Clark  Bicentennial  Commission
26    regarding  the  design,  color, and format of the plates. The
27    Secretary may, in his or her discretion, allow the plates  to
28    be issued as vanity or personalized plates in accordance with
29    Section 3-405.1 of this Code.  The plates are not required to

 1    designate  "Land Of Lincoln", as prescribed in subsection (b)
 2    of Section 3-412 of this Code.  The Secretary, in his or  her
 3    discretion, shall approve and prescribe stickers or decals as
 4    provided under Section 3-412.
 5        (c)  An applicant shall be charged a $40 fee for original
 6    issuance  in addition to the applicable registration fee.  Of
 7    this  additional  fee,  $15   shall  be  deposited  into  the
 8    Secretary of State Special License Plate Fund and  $25  shall
 9    be deposited into the Lewis and Clark Bicentennial Fund.  For
10    each  registration  renewal period, a $27 fee, in addition to
11    the appropriate registration fee, shall be charged.  Of  this
12    additional  fee,  $2 shall be deposited into the Secretary of
13    State Special License Plate Fund and $25 shall  be  deposited
14    into the Lewis and Clark Bicentennial Fund.
15        (d)  The  Secretary  of State shall issue special license
16    plates under this Section on and before  September  1,  2008.
17    The Secretary may not issue special plates under this Section
18    after September 1, 2008.
19        (e)  The  Lewis and Clark Bicentennial Fund is created as
20    a special fund in the State treasury. All moneys in the Lewis
21    and Clark Bicentennial Fund shall, subject  to  appropriation
22    by  the  General  Assembly  and approval by the Secretary, be
23    used by the Department of Commerce and Community  Affairs  to
24    promote  tourism and education related to the Lewis and Clark
25    Expedition and for historic preservation purposes related  to
26    the Expedition.
27        The  State  Treasurer shall transfer any moneys remaining
28    in the Lewis and Clark Bicentennial Fund on September 1, 2009
29    and any moneys received for deposit  into  that  Fund  on  or
30    after  September  1, 2009 into the Secretary of State Special
31    License Plate Fund.
