1 AN ACT in relation to public aid.
2 Be it enacted by the People of the State of Illinois,
3 represented in the General Assembly:
4 Section 5. The Illinois Public Aid Code is amended by
5 adding Section 5-5.22 as follows:
6 (305 ILCS 5/5-5.22 new)
7 Sec. 5-5.22. Long-term care facilities; prescription
8 drugs.
9 (a) A skilled nursing or intermediate care facility may
10 request payment from the Illinois Department only for
11 prescription drugs actually used and administered to
12 residents of the facility, and the Illinois Department shall
13 provide payment under this Article only for prescription
14 drugs actually used and administered to residents of the
15 facility.
16 (b) If a facility has dispensed for a resident a greater
17 amount of one or more prescription drugs than are used and
18 actually administered to the resident, the facility may
19 redispense those drugs to be administered to a different
20 resident than the one for whom they were originally
21 dispensed.
