1 AN ACT in relation to criminal law.
2 Be it enacted by the People of the State of Illinois,
3 represented in the General Assembly:
4 Section 5. The Code of Criminal Procedure of 1963 is
5 amended by adding Section 115-21 as follows:
6 (725 ILCS 5/115-21 new)
7 Sec. 115-21. Nurse testimony. In a criminal prosecution
8 for criminal sexual assault, aggravated criminal sexual
9 assault, predatory criminal sexual assault of a child,
10 criminal sexual abuse, or aggravated criminal sexual abuse, a
11 registered nurse who uses the State Police Evidence
12 Collection Kit (S.P.E.C.K.) at a licensed hospital to collect
13 evidence of a sexual assault or abuse from alleged sexual
14 assault or abuse survivors under the Sexual Assault Survivors
15 Emergency Treatment Act is qualified to testify at trial as
16 an expert on emergency services provided to sexual assault
17 survivors if the hospital in which the nurse is employed uses
18 the Kit in accordance with the rules adopted by the Illinois
19 State Police under that Act.
