 1        AN ACT in relation to the regulation of professions.

 2        Be it enacted by the People of  the  State  of  Illinois,
 3    represented in the General Assembly:

 4        Section  5.  The Illinois Optometric Practice Act of 1987
 5    is amended by changing Sections 12 and 22 as follows:

 6        (225 ILCS 80/12) (from Ch. 111, par. 3912)
 7        Sec. 12.  Applications  for  licenses  and  certificates.
 8    Applications  for original licenses and certificates shall be
 9    made to the Department in writing on forms prescribed by  the
10    Department  and  shall  be  accompanied  by the required fee,
11    which shall not be refundable.  Any  such  application  shall
12    require such information as in the judgment of the Department
13    will  enable  the Department to pass on the qualifications of
14    the applicant for a license or certificate.
15        An applicant for initial licensure  in    Illinois  shall
16    apply  for  and  be  qualified  to receive and shall maintain
17    certification  to  use  diagnostic  and  therapeutic   ocular
18    pharmaceuticals.
19        Applicants  have  3 years from the date of application to
20    complete the application process.  If  the  process  has  not
21    been  completed  within  3  years,  the  application shall be
22    denied, the application fees  shall  be  forfeited,  and  the
23    applicant must reapply and meet the requirements in effect at
24    the time of reapplication.
25        Applicants  who  meet  all other conditions for licensure
26    and who will be practicing optometry in a  residency  program
27    approved by the Board may apply for and receive a limited one
28    year  license  to  practice  optometry  as  a resident in the
29    program.  A licensee who receives  a  limited  license  under
30    this   Section   shall   have   the   same   privileges   and
31    responsibilities as a therapeutically certified licensee.

 3        Sec.   22.   Any  person  licensed  under  this  Act  may
 4    advertise the availability of professional  services  in  the
 5    public  media  or  on  the  premises  where such professional
 6    services are  rendered  provided  that  such  advertising  is
 7    truthful  and  not misleading and is in conformity with rules
 8    promulgated by the Department.
 9        It is unlawful for any person licensed under this Act  to
10    use  testimonials  or  claims  of superior quality of care to
11    entice the public.

13        Section 99.  Effective date.  This Act takes effect  upon
14    becoming law.
