1 AN ACT in relation to environmental safety.
2 Be it enacted by the People of the State of Illinois,
3 represented in the General Assembly:
4 Section 5. The Environmental Protection Act is amended
5 by changing Section 57.13 as follows:
6 (415 ILCS 5/57.13)
7 Sec. 57.13. Underground Storage Tank Program; transition.
8 (a) If a release is reported to the proper State
9 authority on or after September 13, 1993 the effective date
10 of this amendatory Act of 1993, the owner or operator shall
11 comply with the requirements of this Title.
12 (b) If a release is reported to the proper State
13 authority prior to the effective date of this amendatory Act
14 of 1993, the owner or operator of an underground storage tank
15 may elect to proceed in accordance with the requirements of
16 this Title by submitting a written statement to the Agency of
17 such election. If the owner or operator elects to proceed
18 under the requirements of this Title all costs incurred in
19 connection with the incident prior to notification shall be
20 reimbursable in the same manner as was allowable under the
21 then existing law. Completion of corrective action shall then
22 follow the provisions of this Title.
