 1        AN ACT in relation to public employee benefits.

 2        Be  it  enacted  by  the People of the State of Illinois,
 3    represented in the General Assembly:

 4        Section 5.  The  Illinois  Pension  Code  is  amended  by
 5    changing Section 7-169 as follows:

 6        (40 ILCS 5/7-169) (from Ch. 108 1/2, par. 7-169)
 7        Sec.  7-169.   Separation  benefits;  repayments.   If an
 8    employee who has received a separation  benefit  subsequently
 9    becomes  a  participating  employee,  and  renders at least 2
10    years of contributing service from the date of such re-entry,
11    he may pay to the fund the amount of the separation  benefit,
12    plus  interest  at  the effective rate for each year from the
13    date of payment of the separation  benefit  to  the  date  of
14    repayment.   Upon  payment  his  creditable  service shall be
15    reinstated and the payment shall be credited to  his  account
16    as  normal  contributions.   Beginning  January  1, 2002, the
17    requirement of returning to service for at least 2 years does
18    not apply to persons who return to service as a sheriff's law
19    enforcement employee.

21        Section 90.  The State Mandates Act is amended by  adding
22    Section 8.25 as follows:

23        (30 ILCS 805/8.25 new)
24        Sec.  8.25.  Exempt  mandate.  Notwithstanding Sections 6
25    and 8 of this Act, no reimbursement by the State is  required
26    for  the  implementation  of  any  mandate  created  by  this
27    amendatory Act of the 92nd General Assembly.

28        Section  99.  Effective date.  This Act takes effect upon
