 1        AN ACT concerning seeds.

 2        Be it enacted by the People of  the  State  of  Illinois,
 3    represented in the General Assembly:

 4        Section  5.  The Illinois Seed Law is amended by changing
 5    Section 4.2 as follows:

 6        (505 ILCS 110/4.2) (from Ch. 5, par. 404.2)
 7        Sec. 4.2. All agricultural seeds must be labeled with:
 8        (1)  The name of the kind or kinds and variety  for  each
 9    agricultural  seed  component  present in excess of 5% of the
10    whole and the percentage by weight of each except as provided
11    by regulation: provided, that if the variety of  those  kinds
12    generally   labeled  as  to  variety  as  designated  in  the
13    regulations is not stated, the label shall show the  name  of
14    the  kind  and the words, "Variety Not Stated". Hybrids shall
15    be labeled as hybrids.
16        (2)  Lot number or other lot identification.
17        (3)  Origin (State or  foreign  country),  if  known,  of
18    alfalfa,  red  clover and field corn (except hybrid corn). If
19    the origin is unknown, the fact shall be stated.
20        (4)  Percentage by weight of all  weed  seeds  except  as
21    provided by regulation.
22        (5)  The  name  and  approximate  number  of each kind of
23    restricted noxious weed seed, per pound in groups  (a),  (b),
24    (c) and (d), when present singly or collectively in excess of
25    (a)  Eighty seeds or bulblets per pound of Agrostis spp., Poa
26    spp.,  Rhodesgrass, Bermudagrass, timothy, orchardgrass, fine
27    textured fescues, alsike and white clover, reed  canarygrass,
28    dallisgrass, and other agricultural seeds of similar size and
29    weight, or mixtures within this group;
30        (b)  Thirty-two  seeds or bulblets per pound of ryegrass,
31    meadow and tall fescues, foxtail millet, crownvetch, alfalfa,

 1    red  clover,  sweetclovers,  lespedezas,  smooth  bromegrass,
 2    crimson clover, flax, Agropyron spp., and other  agricultural
 3    seeds  of  similar  size  and weight, or mixtures within this
 4    group, or of this group with (a);
 5        (c)  Sixteen  seeds  or  bulblets  per  pound  of  proso,
 6    Sudangrass and other agricultural seeds of similar  size  and
 7    weight, or mixtures not specified in (a), (b), or (d);
 8        (d)  Four  seeds  or  bulblets  per pound of wheat, oats,
 9    rye, barley, buckwheat, sorghums (except Sudangrass), vetches
10    and other agricultural seeds of a size and weight similar  to
11    or  greater  than  those  within  this group, or any mixtures
12    within this group.
13        (6)  Percentage by weight of  agricultural  seeds  (which
14    may  be designated as "crop seeds") other than those required
15    to be named on the label.
16        (7)  Percentage by weight of inert matter.
17        (8)  For each named agricultural seed:
18        (a)  Percentage of  germination,  exclusive  of  hard  or
19    dormant seed.
20        (b)  Percentage of hard or dormant seeds, if present.
21        (c)  The  calendar  month and year the test was completed
22    to determine such percentages.
23        Following (a) and (b) the "total germination and hard  or
24    dormant seed" may be stated as such, if desired.
25        (9)  Name,  and  address,  and  toll-free  number  of the
26    person who labeled said seed, or who sells, offers or exposes
27    said seed for sale within this State.

29        Section 99.  Effective date.  This Act takes effect  upon
30    becoming law.
