92_HB0909ham002 LRB9203975JMmbam01 1 AMENDMENT TO HOUSE BILL 909 2 AMENDMENT NO. . Amend House Bill 909, AS AMENDED, by 3 replacing the title with the following: 4 "AN ACT in relation to the Illinois work force."; and 5 by replacing everything after the enacting clause with the 6 following: 7 "Section 1. Short title. This Act may be cited as the 8 Illinois FIRST Job Opportunities Initiative Act. 9 Section 5. Illinois FIRST Job Opportunities Initiative. 10 (a) For any construction contract with the value of 11 $1,000,000 or more funded in whole or part by Illinois FIRST 12 funds or by any State funds, the State of Illinois shall post 13 the following information pursuant to the procedures set 14 forth in subsection (c): 15 (1) the approximate number of apprenticeship and 16 journey-level hours that will be required and available 17 for each skilled and unskilled trade to be utilized 18 within any contract and subcontract to be awarded for 19 that project, and any other employment opportunity to be 20 made available pursuant to such contract or subcontract; 21 (2) the approximate period of time during which -2- LRB9203975JMmbam01 1 work on any contract or subcontract will continue, 2 including the approximate beginning date that any 3 employment opportunity will arise pursuant to the 4 contract; 5 (3) the description and location of the 6 construction project; and 7 (4) the specific procedures that must be followed 8 to apply for any employment opportunities arising from 9 the contract or subcontract, including location and hours 10 of any union or other offices. 11 (b) Any prime contractor receiving any construction 12 contract with the value of $1,000,000 or more funded in whole 13 or part by Illinois FIRST funds or by any State funds shall, 14 on the date the contract is awarded by the State, supply the 15 Department of Employment Security with the employment 16 information specified in subsection (a); provided that for 17 any subcontract awarded during the duration of the contract, 18 the information specified in subsection (a) shall be provided 19 by the prime contractor on the date the subcontract is 20 awarded. Any such contract shall include the requirement for 21 the prime contractor to supply the information within the 22 timeframes set forth in this subsection. 23 (c) All employment opportunities required to be posted 24 under this Section shall be submitted by a prime contractor 25 to the Department of Employment Security, utilizing forms and 26 procedures developed and made available by the Department. 27 The Department of Employment Security shall, upon receipt of 28 such information from any prime contractor: 29 (1) post the information on an appropriate State of 30 Illinois Internet site; 31 (2) post the information with the job service 32 program maintained by the State; 33 (3) post the information with all Illinois 34 Employment and Training Centers throughout the State; and -3- LRB9203975JMmbam01 1 (4) provide electronic links to the Illinois 2 Department of Transportation website and the Capital 3 Development Board website where the information, specific 4 to those agencies shall also be posted. 5 In addition, the information provided to the Department 6 of Employment Security shall be provided by the prime 7 contractor or his or her representative to any person who 8 seeks employment directly at the job site at an office or 9 trailer where site business is conducted. The information, 10 or reference as to how to obtain it, shall also be posted in 11 an easily accessible public place at the same location. 12 (d) Any prime contractor awarded a construction contract 13 with the value of $1,000,000 or more, funded in whole or part 14 by Illinois FIRST funds or by any State funds, shall submit a 15 monthly report to the State of Illinois that shall include 16 information as to the number of apprenticeship and 17 journey-level hours worked by race and gender in each skilled 18 and unskilled trade on all projects employing skilled or 19 unskilled labor during the preceding month. The Governor 20 shall designate an office within a State agency that shall be 21 responsible for the development and dissemination of a simple 22 reporting form, both in paper and electronic format, to be 23 utilized by all State agencies and prime contractors covered 24 under this Section and shall be further responsible for 25 monitoring compliance with the reporting requirements 26 specified in this subsection. Any report submitted pursuant 27 to this subsection shall be made available, at a nominal 28 charge, to any member of the public who requests a copy. 29 Section 99. Effective date. This Act takes effect upon 30 becoming law.".
