1 AMENDMENT TO HOUSE BILL 800
2 AMENDMENT NO. . Amend House Bill 800 by replacing
3 everything after the enacting clause with the following:
4 "Section 5. The Illinois Insurance Code is amended by
5 adding Section 370u as follows:
6 (215 ILCS 5/370u new)
7 Sec. 370u. Independent contractor compensation. All
8 noninstitutional providers and other providers shall be
9 permitted to compensate, on the basis of a percentage of the
10 providers' fees or collections, any independent contractor
11 (including, but not limited to, an administrator, insurer,
12 and health maintenance organization licensed under the Health
13 Maintenance Organization Act) for non-health care services
14 provided in connection with the management, marketing,
15 administration, formation, and maintenance of provider
16 networks offered or available to any person, including
17 insured or self-insured employers or employee benefit trust
18 funds. To the extent of any conflict between this provision
19 and any other statutory provision, this provision prevails
20 over the conflicting provision.
21 Section 99. Effective date. This Act takes effect on
