 1        AN ACT concerning gas storage.

 2        Be it enacted by the People of  the  State  of  Illinois,
 3    represented in the General Assembly:

 4        Section  5.   The  Gas Storage Act is amended by changing
 5    Section 1 as follows:

 6        (220 ILCS 15/1) (from Ch. 96 1/2, par. 5501)
 7        Sec. 1. Any corporation which is engaged in or desires to
 8    engage in, the distribution,  transportation  or  storage  of
 9    natural  gas  or  manufactured gas, which gas, in whole or in
10    part, is intended for ultimate distribution to the public  in
11    the   State  of  Illinois,  if  the  said  business  of  such
12    corporation is  regulated  or  subject  to  regulation  under
13    either  the  laws of the State of Illinois or the laws of the
14    United States, shall have the right to enter  upon,  take  or
15    damage  private  property  or  any  interest  therein, in the
16    manner provided for by the law of eminent  domain,  necessary
17    or  convenient for its said operations, including the storage
18    of gas, all of which operations  are  hereby  recognized  and
19    declared to be affected with a public interest and all of the
20    property  used  in  which operations is hereby recognized and
21    declared to be devoted to public use. If a person (i) holds a
22    certificate of public convenience and necessity issued  under
23    the  federal  Natural Gas Act (that is, under 15 U.S.C. 717f)
24    for the construction of a pipeline for the transportation  of
25    natural gas and (ii) desires to exercise the right of eminent
26    domain  as  authorized  in  that  Act,  then  the person must
27    exercise that right in a proceeding under Article VII of  the
28    Code of Civil Procedure in the circuit court of the county in
29    which the property to be acquired is located.

 1        Section  99.  Effective date.  This Act takes effect upon
 2    becoming law.
