 1        AN ACT concerning historic preservation.

 2        Be  it  enacted  by  the People of the State of Illinois,
 3    represented in the General Assembly:

 4        Section 5.  The Illinois  Historic  Preservation  Act  is
 5    amended by adding Section 20 as follows:

 6        (20 ILCS 3410/20 new)
 7        Sec. 20.  Historic Preservation Advisory Council.
 8        (a)  In   order   to  enhance  public  participation  and
 9    involvement in the preservation and protection of the State's
10    historic and archaeological sites and  properties,  there  is
11    created  within the Illinois Historic Preservation Agency the
12    Historic Preservation Advisory Council.
13        The Council shall consist of  12  members  who  represent
14    different  areas  of  the  State and who are appointed by the
15    Governor with the advice and  consent  of  the  Senate.   The
16    Council members must be qualified as follows:
17             (1)  At   least   5  members  shall  have  practical
18        experience   in   the   preservation   of   historic   or
19        archaeological sites and properties  as  demonstrated  in
20        one  or  more  of  the  following  fields:  architecture,
21        architectural  history,  historic  preservation, history,
22        archaeology, or  a  local  historic  preservation  board,
23        commission,  or  nonprofit  organization.  No employee or
24        contractual   employee   of   the    Illinois    Historic
25        Preservation Agency may serve on the Council.
26             (2)  Each  of  at  least  5  members  shall  be  the
27        president,   chief   elected   officer,   or  other  duly
28        authorized representative of a  statewide  commercial  or
29        residential  developers  association,  statewide realtors
30        association, or economic development organization.
31             (3)  The  remaining  2  members  shall  be  at-large

 1        members.
 2        (b)  Members shall be appointed for 4-year terms,  except
 3    for  an appointment to fill an unexpired term, in which event
 4    the appointment shall be for the remainder of  the  unexpired
 5    term  only.   No  person  shall serve more than 2 consecutive
 6    terms on the Council.
 7        (c)  Members shall  elect  a  chairperson  annually.   No
 8    member shall be elected to consecutive terms as chairperson.
 9        (d)  The Council shall meet at least quarterly throughout
10    the  State fiscal year.  However, the chairperson, a majority
11    of the members,  or  the  Agency  may  convene  the  Council.
12    Members  shall  serve  without  pay, but shall be entitled to
13    reimbursement for expenses incurred  in  the  performance  of
14    their  duties.   All  members  of  the Council shall be legal
15    residents of the State.
16        (e)  All action taken by the Council shall be by majority
17    vote of those present.  The Director of  the  Agency  or  the
18    Director's  designee  shall  serve  without  voting rights as
19    secretary to the Council.  The Agency shall provide necessary
20    staff assistance to the Council.
21        (f)  It shall be the responsibility  of  the  Council  to
22    provide assistance, advice, and recommendations to the Agency
23    in:
24             (1)  Establishing priorities for the identification,
25        acquisition, protection, and preservation of historic and
26        archaeological sites and properties.
27             (2)  Establishing  criteria for use in assessing the
28        significance of historic  and  archaeological  sites  and
29        properties.
30             (3)  Evaluating  proposals  for  awards  of historic
31        preservation grants  administered  by  the  Agency.   The
32        Council  shall  review  and  evaluate  all  proposals for
33        grants  and  shall  make  recommendations,  including   a
34        priority  ranking, reflecting such evaluation.  In making

 1        such evaluation and recommendations, the  Council  shall,
 2        at  a  minimum,  consider the purpose, economic and other
 3        public benefit, location,  compatibility  with  statewide
 4        historic   preservation  priorities,  and  cost  of  each
 5        proposal for grant assistance.
 6             (4)  Preparing  rules  relating  to   the   historic
 7        preservation programs administered by the Agency.
 8        (g)  It  shall  be  the  additional responsibility of the
 9    Council to provide such other assistance and  advice  to  the
10    Agency  as  may  be  required  from  time  to time in matters
11    pertaining to the protection and preservation of the  State's
12    historic and archaeological sites and properties.

13        Section  99.  Effective date.  This Act takes effect upon
14    becoming law.
