1 AN ACT to amend the Election Code by adding Section
2 9-25.3.
3 Be it enacted by the People of the State of Illinois,
4 represented in the General Assembly:
5 Section 5. The Election Code is amended by adding
6 Section 9-25.3 as follows:
7 (10 ILCS 5/9-25.3 new)
8 Sec. 9-25.3. Cash contributions; limits.
9 (a) No candidate or political committee may accept cash
10 contributions in excess of $150 from any person or entity
11 during any semi-annual reporting period.
12 (b) Any contribution in excess of $150, other than
13 in-kind contributions, must be made by negotiable instrument
14 or be evidenced by an itemized credit card receipt bearing on
15 its face the name of the remitter.
16 (c) For purposes of this Section, a cash contribution is
17 deemed to have been accepted (i) if it is negotiated or
18 deposited or (ii) if it is not returned to the contributor
19 within 5 business days after receipt.
20 (d) A violation under this Section is a Class A
21 misdemeanor. In addition to any other penalty prescribed by
22 this Section, a person convicted of a violation of subsection
23 (a) must be fined 3 times the amount of the contributions
24 found to have been accepted in violation this Section.
25 (e) Any contribution accepted in violation of this
26 Section escheats to the State of Illinois.
27 Section 99. Effective date. This Act takes effect upon
28 becoming law.
