 1        AN ACT concerning criminal law.

 2        Be it enacted by the People of  the  State  of  Illinois,
 3    represented in the General Assembly:

 4        Section  5.   The  Criminal  Code  of  1961 is amended by
 5    adding Section 12-9.1 as follows:

 6        (720 ILCS 5/12-9.1 new)
 7        Sec. 12-9.1.  Threatening a  school  employee  or  school
 8    officer.
 9        (a)  A person commits the offense of threatening a school
10    employee or school officer when:
11             (1)  that person knowingly and willfully delivers or
12        conveys  to  any  employee  or  officer  of any public or
13        private  educational  institution  within  this  State  a
14        communication:
15                  (i)  containing a threat that would  place  the
16             school employee or school officer or a member of his
17             or  her  immediate family in reasonable apprehension
18             of immediate or future bodily harm, sexual  assault,
19             confinement, or restraint; or
20                  (ii)  containing  a threat that would place the
21             school employee or school officer or a member of his
22             or her immediate family in  reasonable  apprehension
23             that  damage  will  occur  to  property in the care,
24             custody, or control of the school employee or school
25             officer or his or her immediate family; and
26             (2)  the threat is made with  intent  to  cause  the
27        school  employee  or school officer to perform or refrain
28        from performing some act or duty within the scope of  his
29        or her office or employment.
30        (b)  Threatening a school employee or school officer is a
31    Class A misdemeanor for a first offense and a Class 4  felony

 1    for a second or subsequent offense.

 2        Section. 99.  This Act takes effect upon becoming law.
