1 AMENDMENT TO HOUSE BILL 389
2 AMENDMENT NO. . Amend House Bill 389, AS AMENDED, by
3 replacing everything after the enacting clause with the
4 following:
5 "Section 5. The Legislative Commission Reorganization
6 Act of 1984 is amended by changing Sections 1-3 and 1-5 and
7 adding Article 3B as follows:
8 (25 ILCS 130/1-3) (from Ch. 63, par. 1001-3)
9 Sec. 1-3. Legislative support services agencies. The
10 Joint Committee on Legislative Support Services is
11 responsible for establishing general policy and coordinating
12 activities among the legislative support services agencies.
13 The legislative support services agencies include the
14 following:
15 (1) Joint Committee on Administrative Rules;
16 (2) Illinois Economic and Fiscal Commission;
17 (3) Illinois Commission on Intergovernmental
18 Cooperation;
19 (4) Legislative Information System;
20 (5) Legislative Reference Bureau;
21 (6) Legislative Audit Commission;
22 (7) Space Needs Commission;

1 (8) Legislative Printing Unit;
2 (9) Legislative Research Unit;
3 (10) Citizens Assembly; and
4 (11) Pension Laws Commission; and
5 (12) School Code Review Commission.

8 Sec. 1-5. Composition of agencies; directors.
9 (a)(1) Each legislative support services agency listed
10 in Section 1-3 is hereafter in this Section referred to as
11 the Agency.
12 (2) The Citizens Assembly shall consist of the 14
13 co-chairpersons of the Citizens Councils created under
14 Article 11A.
15 (2.1) The Pension Laws Commission shall consist of 8
16 members of the General Assembly, of whom 2 shall be appointed
17 by the President of the Senate, 2 shall be appointed by the
18 Minority Leader of the Senate, 2 shall be appointed by the
19 Speaker of the House of Representatives, and 2 shall be
20 appointed by the Minority Leader of the House of
21 Representatives; plus 8 public members with knowledge of
22 privately funded and operated pension plans, of whom 2 shall
23 be appointed by the President of the Senate, 2 shall be
24 appointed by the Minority Leader of the Senate, 2 shall be
25 appointed by the Speaker of the House of Representatives, and
26 2 shall be appointed by the Minority Leader of the House of
27 Representatives. All appointments shall be in writing and
28 filed with the Secretary of State as a public record.
29 Legislative members of the Pension Laws Commission shall
30 be appointed during the month of January in each odd-numbered
31 year for 2-year terms beginning February 1. Any vacancy on
32 the Commission shall be filled by appointment for the balance
33 of the term in the same manner as the original appointment.

1 A vacancy exists when a legislative member ceases to hold the
2 elected legislative office held at the time of appointment.
3 The initial legislative members of the Commission shall be
4 appointed as soon as practicable after the effective date of
5 this amendatory Act and shall serve until January 31, 1997.
6 (2.5) The School Code Review Commission consists of 10
7 members as follows: one member appointed by the Governor,
8 the State Superintendent of Education or his or her designee,
9 2 members of the House appointed by the Speaker of the House,
10 2 members of the House appointed by the Minority Leader of
11 the House, 2 members of the Senate appointed by the President
12 of the Senate, and 2 members of the Senate appointed by the
13 Minority Leader of the Senate. The Commission also includes
14 12 advisors appointed one each by the following:
15 (i) Illinois Statewide School Management Alliance.
16 (ii) Illinois Education Association.
17 (iii) Illinois Federation of Teachers.
18 (iv) ED-RED.
19 (v) Large Unit District Association.
20 (vi) South Cooperative Organization for Public
21 Education.
22 (vii) Illinois PTA Congress of Parents & Teachers.
23 (viii) Illinois Business Education Coalition.
24 (ix) Illinois Association of Regional
25 Superintendents of Schools.
26 (x) Board of Higher Education.
27 (xi) Chicago Board of Education.
28 (xii) Catholic Conference of Illinois.
29 The Commission may, by an affirmative vote of the
30 majority of the members, add additional advisors.
31 Appointments must be in writing and filed with the Secretary
32 of State as a public record.
33 Members of the School Code Review Commission are voting
34 members. Advisors may not vote. Members and advisors are

1 appointed in January of each odd-numbered year for 2-year
2 terms beginning February 1, except that initial members and
3 advisors must be appointed as soon as possible after the
4 effective date of this amendatory Act of the 92nd General
5 Assembly and shall serve through January 31, 2003.
6 A vacancy on the School Code Review Commission must be
7 filled by appointment of the original appointing authority
8 for the balance of the unexpired term, except in the case of
9 initial legislative members, where a vacancy exists when a
10 legislative member ceases to hold the elected legislative
11 office he or she held at the time of appointment.
12 (3) The other legislative support services agencies
13 shall each consist of 12 members of the General Assembly, of
14 whom 3 shall be appointed by the President of the Senate, 3
15 shall be appointed by the Minority Leader of the Senate, 3
16 shall be appointed by the Speaker of the House of
17 Representatives, and 3 shall be appointed by the Minority
18 Leader of the House of Representatives. All appointments
19 shall be in writing and filed with the Secretary of State as
20 a public record.
21 Members shall serve a two year term, and must be
22 appointed by the Joint Committee during the month of January
23 in each odd-numbered year for terms beginning February 1.
24 Any vacancy in an Agency shall be filled by appointment for
25 the balance of the term in the same manner as the original
26 appointment. A vacancy shall exist when a member no longer
27 holds the elected legislative office held at the time of the
28 appointment or at the termination of the member's legislative
29 service.
30 (b) (Blank).
31 (c) Every two years the members of each Agency shall
32 elect, during the month of February of each odd-numbered
33 year, 2 co-chairmen and such other officers as they deem
34 necessary. If members of the Agency cannot agree on the

1 co-chairmen by March 1 of the odd-numbered year, the
2 co-chairmen shall be selected from among the members by the
3 Joint Committee on Legislative Support Services. The
4 co-chairmen of each Agency shall serve for a two-year term,
5 beginning February 1 of the odd-numbered year, and the 2
6 co-chairmen shall not be members of or identified with the
7 same house or the same political party. If a co-chairman of
8 the Citizens Assembly is not a member of the General
9 Assembly, he shall be considered to be identified with the
10 house and the political party of the legislative leader by
11 whom he was appointed. The co-chairmen of the Pension Laws
12 Commission and the School Code Review Commission shall be
13 legislative members of the Commission.
14 Each Agency shall meet twice annually or more often upon
15 the call of the chair or a majority of the voting any 9
16 members. A quorum of the Agency shall consist of a majority
17 of the appointed members.
18 (d) Members of each Agency shall serve without
19 compensation, but shall be reimbursed for expenses incurred
20 in carrying out the duties of the Agency pursuant to rules
21 and regulations adopted by the Joint Committee on Legislative
22 Support Services.
23 (e) Beginning February 1, 1985, and every two years
24 thereafter, the Joint Committee shall select an Executive
25 Director who shall be the chief executive officer and staff
26 director of each Agency. The Joint Committee shall select an
27 Executive Director of the School Code Review Commission as
28 soon as possible after the effective date of this amendatory
29 Act of the 92nd General Assembly. The Executive Director
30 shall receive a salary as fixed by the Joint Committee and
31 shall be authorized to employ and fix the compensation of
32 necessary professional, technical and secretarial staff and
33 prescribe their duties, sign contracts, and issue vouchers
34 for the payment of obligations pursuant to rules and

1 regulations adopted by the Joint Committee on Legislative
2 Support Services. The Executive Director and other employees
3 of the Agency shall not be subject to the Personnel Code.

8 Sec. 3B-1. School Code Review Commission.
9 (a) The School Code Review Commission is established as
10 a legislative support services agency. The Commission is
11 subject to the provisions of this Act. It has the powers and
12 duties delegated to it under this Act and must perform any
13 other functions that may be provided by law.
14 (b) It is the duty of the School Code Review Commission
15 to undertake a comprehensive and thorough review of every
16 Article of the School Code and related laws and rules
17 impacting Illinois' K-12 schools, as well as the powers and
18 duties of the State Board of Education, with the intent of
19 eliminating unnecessary and burdensome mandates on school
20 districts, increasing accountability and efficiency in
21 schools, returning control of school districts to locally
22 elected school officials, teachers, administrators, and
23 parents, and improving the educational performance of
24 students.
25 (c) The School Code Review Commission shall issue a
26 report detailing specific recommended changes to the School
27 Code, related laws and rules, and the powers and duties of
28 the State Board of Education, to be filed with the General
29 Assembly and the Governor before July 1, 2003.
30 (d) The School Code Review Commission may request
31 assistance from any other entity as necessary or useful for
32 the performance of its duties.

1 (e) The School Code Review Commission is abolished on
2 July 1, 2003.
3 Section 99. Effective date. This Act takes effect upon
4 becoming law.".
