 1                     AMENDMENT TO HOUSE BILL 148

 2        AMENDMENT NO.     .  Amend House Bill  148  by  replacing
 3    the title with the following:

 4        "AN ACT concerning police officers."; and

 5    by  replacing  everything  after the enacting clause with the
 6    following:

 7        "Section 5.  The Illinois Police Training Act is  amended
 8    by  changing  Section  8.2  and  by  adding  Section  10.2 as
 9    follows:

10        (50 ILCS 705/8.2)
11        Sec. 8.2. Part-time police officers.
12        (a)  A person  hired  to  serve  as  a  part-time  police
13    officer   must  obtain  from  the  Board  a  certificate  (i)
14    attesting  to  his  or  her  successful  completion  of   the
15    part-time  police  training  course; (ii) attesting to his or
16    her satisfactory completion of a training program of  similar
17    content and number of hours that has been found acceptable by
18    the  Board  under  the  provisions  of  this  Act;  or  (iii)
19    attesting  to  the  Board's  determination that the part-time
20    police training course is unnecessary because of the person's
21    extensive prior law enforcement experience. A person hired on

 1    or after the effective date of this  amendatory  Act  of  the
 2    92nd  General Assembly must obtain this certificate within 18
 3    months after the initial  date  of  hire  as  a  probationary
 4    part-time  police  officer  in  the  State  of  Illinois. The
 5    probationary part-time police officer must  be  enrolled  and
 6    accepted  into  a Board-approved course within 6 months after
 7    active employment by any department in the  State.  A  person
 8    hired  on  or  after January 1, 1996 and before the effective
 9    date of this amendatory Act of the 92nd General Assembly must
10    obtain this certificate within 18 months after  the  date  of
11    hire.  A person hired before January 1, 1996 must obtain this
12    certificate within 24 months after the effective date of this
13    amendatory Act of 1995.
14        The  employing  agency  may  seek a waiver from the Board
15    extending the period  for  compliance.   A  waiver  shall  be
16    issued  only  for  good  and  justifiable  reasons,  and  the
17    probationary  part-time  police officer may not practice as a
18    part-time police officer during the waiver period and may not
19    extend the initial period by more than 90 days.  If  training
20    is  required  and  not  completed  within the applicable time
21    period, as extended by any waiver that may be  granted,  then
22    the officer must forfeit his or her position.
23        (b)  (Blank).
24        (c)  The  part-time police training course referred to in
25    this  Section shall be of similar content and the same number
26    of hours as the courses for full-time officers and  shall  be
27    provided  by  Mobile Team In-Service Training Units under the
28    Intergovernmental  Law   Enforcement   Officer's   In-Service
29    Training  Act or by another approved program or facility in a
30    manner prescribed by the Board.
31        (d)  For the purposes of this Section,  the  Board  shall
32    adopt   rules  defining  what  constitutes  employment  on  a
33    part-time basis.

 1        (50 ILCS 705/10.2 new)
 2        Sec. 10.2 Criminal background investigations.
 3        (a)  On and after the effective date of  this  amendatory
 4    Act of the 92nd General Assembly, an applicant for employment
 5    as  a  peace  officer  shall  authorize  an  investigation to
 6    determine if the applicant has been convicted of any criminal
 7    offense that disqualifies the person as a peace officer.
 8        (b)  No law enforcement agency  may  knowingly  employ  a
 9    person unless (i) a criminal background investigation of that
10    person has been completed and (ii) that investigation reveals
11    no  convictions  of  offenses  specified in subsection (a) of
12    Section 6.1 of this Act.

13        Section 90.  The State Mandates Act is amended by  adding
14    Section 8.25 as follows:

15        (30 ILCS 805/8.25 new)
16        Sec.  8.25.  Exempt  mandate.  Notwithstanding Sections 6
17    and 8 of this Act, no reimbursement by the State is  required
18    for  the  implementation  of  any  mandate  created  by  this
19    amendatory Act of the 92nd General Assembly.

20        Section  99.  Effective date.  This Act takes effect upon
21    becoming law.".
