 1        AN ACT concerning insurance.

 2        Be  it  enacted  by  the People of the State of Illinois,
 3    represented in the General Assembly:

 4        Section 5.  The Illinois Insurance  Code  is  amended  by
 5    adding Section 356z.1 as follows:

 6        (215 ILCS 5/356z.1 new)
 7        Sec.  356z.1.  Surgical assistants. A group or individual
 8    policy of accident and health insurance  amended,  delivered,
 9    issued,   or   renewed  after  the  effective  date  of  this
10    amendatory Act of the 92nd  General  Assembly  that  provides
11    coverage   for   health  care  services,  including  surgical
12    services, must provide coverage for services rendered  by  an
13    assistant in surgery authorized or credentialed by a hospital
14    or  ambulatory  surgical treatment center to provide surgical
15    assistance to a physician licensed to  practice  medicine  in
16    all its branches.  An assistant in surgery may be a physician
17    licensed   to  practice  medicine  in  all  its  branches,  a
18    physician assistant, an advanced practice registered nurse, a
19    registered professional  nurse,  or  a  nationally  certified
20    surgical assistant or nationally certified first assistant.

21        Section  10.  The  Health Maintenance Organization Act is
22    amended by changing Section 4-6.5 as follows:

24        Sec.  4-6.5.  Required   health   benefits.    A   health
25    maintenance  organization  is  subject  to  the provisions of
26    Sections 356t, and 356u, and 356z.1 of the Illinois Insurance
27    Code.

 1        Section 15.  The Voluntary Health Services Plans  Act  is
 2    amended by changing Section 10 as follows:

 3        (215 ILCS 165/10) (from Ch. 32, par. 604)
 4        Sec.   10.  Application  of  Insurance  Code  provisions.
 5    Health services plan corporations and all persons  interested
 6    therein   or  dealing  therewith  shall  be  subject  to  the
 7    provisions of Articles IIA and XII 1/2 and Sections 3.1, 133,
 8    140, 143, 143c, 149, 354,  355.2,  356r,  356t,  356u,  356v,
 9    356w,  356x, 356y, 356z.1, 367.2, 368a, 401, 401.1, 402, 403,
10    403A, 408, 408.2, and 412, and paragraphs  (7)  and  (15)  of
11    Section 367 of the Illinois Insurance Code.

16        Section  99.  Effective date.  This Act takes effect upon
