91_SB0949eng SB949 Engrossed LRB9103573DHmg 1 AN ACT to amend the Children and Family Services Act by 2 changing Section 5c. 3 Be it enacted by the People of the State of Illinois, 4 represented in the General Assembly: 5 Section 5. The Children and Family Services Act is 6 amended by changing Section 5c as follows: 7 (20 ILCS 505/5c) 8 Sec. 5c. Direct child welfare service employee license. 9 (a) By January 1, 2000, the Department, in consultation 10 with private child welfare agencies, shall develop and 11 implement a direct child welfare service employee license. 12 By January 1, 2001 all child protective investigators and 13 supervisors and child welfare specialists and supervisors 14 employed by the Department or its contractors mustshall be15required todemonstrate sufficient knowledge and skills to 16 obtain and maintain the license, except as otherwise provided 17 in subsection (b). The Department shall have the authority to 18 revoke or suspend the license of anyone who after a hearing 19 is found to be guilty of misfeasance. The Department shall 20 promulgate such rules as necessary to implement this Section. 21 On or before January 1, 2000, and every year thereafter, 22 the Department shall submit an annual report to the General 23 Assembly on the implementation of this Section. 24 (b) All employees of the Department or its contractors 25 who are employed on the effective date of this amendatory Act 26 of 1999 shall have until January 1, 2003 to obtain the 27 required license. All new employees of the Department and 28 its contractors shall be required to obtain the direct child 29 welfare service employee license as stipulated in Department 30 rules. By January 1, 2000, the Department, in consultation 31 with private child welfare agencies, shall develop a plan to SB949 Engrossed -2- LRB9103573DHmg 1 ensure that current employees of the Department and its 2 contracting agencies will be able to acquire the knowledge 3 and skill necessary to obtain this license. The Department 4 shall have the authority to revoke or suspend the license of 5 anyone who after a hearing is found to be guilty of 6 misfeasance.
