 1                    AMENDMENT TO SENATE BILL 728

 2        AMENDMENT NO.     .  Amend Senate Bill  728  on  page  1,
 3    line 20, by inserting ", including photographs if available,"
 4    after "information"; and

 5    on  page  3,  by  inserting  between  lines  30  and  31  the
 6    following:
 7        "(4)  A photograph of the sex offender."; and

 8    on  page  4,  by  inserting  between  lines  13  and  14  the
 9    following:
10        "(d)  A  law  enforcement  agency may post photographs of
11    child sex offenders on the Internet or  in  its  office.   As
12    used in this subsection (d):
13        "Internet"  means  an  interactive  computer  service  or
14    system  or an information service, system, or access software
15    provider that provides or enables computer access by multiple
16    users to a computer server, and includes, but is not  limited
17    to,  an  information  service,  system,  or  access  software
18    provider  that  provides  access to a network system commonly
19    known as the Internet, or any comparable  system  or  service
20    and  also  includes,  but is not limited to, a World Wide Web
21    page, newsgroup, message board, mailing list, or chat area on
22    any interactive computer service or system  or  other  online
23    service.

 1        "Access"  and  "computer"  have  the meanings ascribed to
 2    them in Section 16D-2 of the Criminal Code of 1961.
 3        "Child sex offender" means a sex  offender  whose  victim
 4    was  under  18  years of age at the time of the commission of
 5    the offense."; and

 6    on page 4, by inserting below line 15, the following:

 7        "Section 95.  Severability.  The provisions of  this  Act
 8    are   severable   under   Section  1.31  of  the  Statute  of
 9    Statutes.".
