1 AN ACT to amend the Public Utilities Act by changing
2 Section 13-209 and adding Section 13-216.
3 Be it enacted by the People of the State of Illinois,
4 represented in the General Assembly:
5 Section 5. The Public Utilities Act is amended by
6 changing Section 13-209 and adding Section 13-216 as follows:
7 (220 ILCS 5/13-209) (from Ch. 111 2/3, par. 13-209)
8 (Section scheduled to be repealed on July 1, 2001)
9 Sec. 13-209. "Competitive Telecommunications Service"
10 means a telecommunications service, its functional equivalent
11 or a substitute service, which, for some identifiable class
12 or group of customers in an exchange, group of exchanges, or
13 some other clearly defined geographical area, is reasonably
14 available from more than one provider, whether or not such
15 provider is a telecommunications carrier subject to
16 regulation under this Act. A telecommunications service may
17 be competitive for the entire state, some geographical area
18 therein, including an exchange or set of exchanges, or for a
19 specific customer or class or group of customers, but only to
20 the extent consistent with this definition. All
21 telecommunications services offered by carriers other than
22 incumbent local exchange carriers are competitive
23 telecommunications services.

26 Sec. 13-216. Incumbent local exchange carrier.
27 "Incumbent local exchange carrier" means a local exchange
28 telecommunications carrier as defined by Section 251(h)(1) of
29 the federal Telecommunications Act of 1996.
