 1        AN ACT to amend the Adoption Act by adding Section 14b.

 2        Be  it  enacted  by  the People of the State of Illinois,
 3    represented in the General Assembly:

 4        Section 5.  The Adoption Act is amended by adding Section
 5    14b as follows:

 6        (750 ILCS 50/14b new)
 7        Sec. 14b.  Death of intended  adoptive  parent  prior  to
 8    entry of judgment.  After any court has acquired jurisdiction
 9    over  the  person  of  any  intended  adoptive  parent  in an
10    adoption proceeding, if the  intended  adoptive  parent  dies
11    before  entry  of  final judgment, upon petition by the other
12    intended adoptive parent or the  child's  guardian  ad  litem
13    suggesting  the  death  of  the  intended adoptive parent and
14    asking that the court proceed  in  absence  of  the  deceased
15    intended  adoptive  parent  to enter a final judgment, in the
16    presence of the other intended adoptive parent or  the  child
17    to  be  adopted who is a party to the record, the court shall
18    proceed to hearing and final judgment to enable the child  to
19    have  the intended name by adoption.  Otherwise the court may
20    dismiss the proceeding.
21        In the case of an adoption proceeding commenced after the
22    death of the person seeking to adopt, the child  intended  to
23    be  adopted shall not, by reason of the adoption, acquire any
24    interest in the estate  of  the  deceased  intended  adoptive
25    parent,  nor  shall  the child intended to be adopted acquire
26    any other right or incur any duty or obligation with  respect
27    to the deceased person.
28        This  amendatory  Act  of the 91st General Assembly shall
29    apply to all cases in which the court  acquired  jurisdiction
30    of  the person of any intended adoptive parent in an adoption
31    proceeding, if such jurisdiction was  acquired  on  or  after
