91_HB1707ham001 LRB9102399KSsbam 1 AMENDMENT TO HOUSE BILL 1707 2 AMENDMENT NO. . Amend House Bill 1707 by replacing 3 everything after the enacting clause with the following: 4 "Section 5. The Illinois Vehicle Code is amended by 5 changing Section 2-119 and adding Section 3-806.5 as follows: 6 (625 ILCS 5/2-119) (from Ch. 95 1/2, par. 2-119) 7 Sec. 2-119. Disposition of fees and taxes. 8 (a) All moneys received from Salvage Certificates shall 9 be deposited in the Common School Fund in the State Treasury. 10 (b) Beginning January 1, 1990 and concluding December 11 31, 1994, of the money collected for each certificate of 12 title, duplicate certificate of title and corrected 13 certificate of title, $0.50 shall be deposited into the Used 14 Tire Management Fund. Beginning January 1, 1990 and 15 concluding December 31, 1994, of the money collected for each 16 certificate of title, duplicate certificate of title and 17 corrected certificate of title, $1.50 shall be deposited in 18 the Park and Conservation Fund. Beginning January 1, 1995, 19 of the money collected for each certificate of title, 20 duplicate certificate of title and corrected certificate of 21 title, $2 shall be deposited in the Park and Conservation 22 Fund. The moneys deposited in the Park and Conservation Fund -2- LRB9102399KSsbam 1 pursuant to this Section shall be used for the acquisition 2 and development of bike paths as provided for in Section 3 63a36 of the Civil Administrative Code of Illinois. Except as 4 otherwise provided in this Code, all remaining moneys 5 collected for certificates of title, and all moneys collected 6 for filing of security interests, shall be placed in the 7 General Revenue Fund in the State Treasury. 8 (c) All moneys collected for that portion of a driver's 9 license fee designated for driver education under Section 10 6-118 shall be placed in the Driver Education Fund in the 11 State Treasury. 12 (d) Beginning January 1, 1999, of the monies collected 13 as a registration fee for each motorcycle, motor driven cycle 14 and motorized pedalcycle, 27% of each annual registration fee 15 for such vehicle and 27% of each semiannual registration fee 16 for such vehicle is deposited in the Cycle Rider Safety 17 Training Fund. 18 (e) Of the monies received by the Secretary of State as 19 registration fees or taxes or as payment of any other fee, as 20 provided in this Act, except fees received by the Secretary 21 under paragraph (7) of subsection (b) of Section 5-101,and22 Section 5-109, and Section 3-806.5 of this Code, 37% shall be 23 deposited into the State Construction Fund. 24 (f) Of the total money collected for a CDL instruction 25 permit or original or renewal issuance of a commercial 26 driver's license (CDL) pursuant to the Uniform Commercial 27 Driver's License Act (UCDLA), $6 of the total fee for an 28 original or renewal CDL, and $6 of the total CDL instruction 29 permit fee when such permit is issued to any person holding a 30 valid Illinois driver's license, shall be paid into the 31 CDLIS/AAMVAnet Trust Fund (Commercial Driver's License 32 Information System/American Association of Motor Vehicle 33 Administrators network Trust Fund) and shall be used for the 34 purposes provided in Section 6z-23 of the State Finance Act. -3- LRB9102399KSsbam 1 (g) All remaining moneys received by the Secretary of 2 State as registration fees or taxes or as payment of any 3 other fee, as provided in this Act, except fees received by 4 the Secretary under paragraph (7) of subsection (b) of 5 Section 5-101 and Section 5-109 of this Code, shall be 6 deposited in the Road Fund in the State Treasury. Moneys in 7 the Road Fund shall be used for the purposes provided in 8 Section 8.3 of the State Finance Act. 9 (h) (Blank). 10 (i) (Blank). 11 (j) (Blank). 12 (k) There is created in the State Treasury a special 13 fund to be known as the Secretary of State Special License 14 Plate Fund. Money deposited into the Fund shall, subject to 15 appropriation, be used by the Office of the Secretary of 16 State (i) to help defray plate manufacturing and plate 17 processing costs for the issuance and, when applicable, 18 renewal of any new or existing special registration plates 19 authorized under this Code and (ii) for grants made by the 20 Secretary of State to benefit Illinois Veterans Home 21 libraries. 22 On or before October 1, 1995, the Secretary of State 23 shall direct the State Comptroller and State Treasurer to 24 transfer any unexpended balance in the Special Environmental 25 License Plate Fund, the Special Korean War Veteran License 26 Plate Fund, and the Retired Congressional License Plate Fund 27 to the Secretary of State Special License Plate Fund. 28 (l) The Motor Vehicle Review Board Fund is created as a 29 special fund in the State Treasury. Moneys deposited into 30 the Fund under paragraph (7) of subsection (b) of Section 31 5-101 and Section 5-109 shall, subject to appropriation, be 32 used by the Office of the Secretary of State to administer 33 the Motor Vehicle Review Board, including without limitation 34 payment of compensation and all necessary expenses incurred -4- LRB9102399KSsbam 1 in administering the Motor Vehicle Review Board under the 2 Motor Vehicle Franchise Act. 3 (m) Effective July 1, 1996, there is created in the 4 State Treasury a special fund to be known as the Family 5 Responsibility Fund. Moneys deposited into the Fund shall, 6 subject to appropriation, be used by the Office of the 7 Secretary of State for the purpose of enforcing the Family 8 Financial Responsibility Law. 9 (n) The Illinois Fire Fighters' Memorial Fund is created 10 as a special fund in the State Treasury. Moneys deposited 11 into the Fund shall, subject to appropriation, be used by the 12 Office of the State Fire Marshal for construction of the 13 Illinois Fire Fighters' Memorial to be located at the State 14 Capitol grounds in Springfield, Illinois. Upon the 15 completion of the Memorial, the Office of the State Fire 16 Marshal shall certify to the State Treasurer that 17 construction of the Memorial has been completed. 18 (o) Of the money collected for each certificate of title 19 for all-terrain vehicles and off-highway motorcycles, $17 20 shall be deposited into the Off-Highway Vehicle Trails Fund. 21 (p) Of the moneys collected for late vehicle 22 registration renewal fees pursuant to Section 3-806.5, $32 of 23 each late renewal fee shall be deposited into the Road Fund 24 and $16 of each late renewal fee shall be deposited into the 25 Live and Learn Fund. 26 (Source: P.A. 89-92, eff. 7-1-96; 89-145, eff. 7-14-95; 27 89-282, eff. 8-10-95; 89-612, eff. 8-9-96; 89-626, eff. 28 8-9-96; 89-639, eff. 1-1-97; 90-14, eff. 7-1-97; 90-287, eff. 29 1-1-98; 90-622, eff. 1-1-99.) 30 (625 ILCS 5/3-806.5 new) 31 Sec. 3-806.5. Late renewal of registration; fee. Every 32 owner of a motor vehicle that is registered for a term 33 pursuant to Section 3-414.1 who fails to renew the vehicle's -5- LRB9102399KSsbam 1 registration fee within 45 days after its expiration, shall 2 be charged $48 for late registration of the motor vehicle, in 3 addition to any other fees. The additional moneys collected 4 from this $48 late renewal fee shall be deposited as provided 5 in subsection (p) of Section 2-119 of this Code.".
