91_HB1138eng HB1138 Engrossed LRB9103396MWks 1 AN ACT concerning advisory questions of public policy, 2 amending named Acts. 3 Be it enacted by the People of the State of Illinois, 4 represented in the General Assembly: 5 Section 5. The Counties Code is amended by adding 6 Section 5-1005.5 as follows: 7 (55 ILCS 5/5-1005.5 new) 8 Sec. 5-1005.5. Advisory referenda. By a vote of the 9 majority of the members of the county board, the board may 10 authorize an advisory question of public policy to be placed 11 on the ballot at the next regularly scheduled election in the 12 county. The county board shall certify the question to the 13 proper election authority, which must submit the question at 14 an election in accordance with the Election Code. 15 Section 10. The Illinois Municipal Code is amended by 16 adding Section 3.1-40-60 as follows: 17 (65 ILCS 5/3.1-40-60 new) 18 Sec. 3.1-40-60. Advisory referenda. By a vote of the 19 majority of the members of the city council, the council may 20 authorize an advisory question of public policy to be placed 21 on the ballot at the next regularly scheduled election in the 22 municipality. The city council shall certify the question to 23 the proper election authority, which must submit the question 24 at an election in accordance with the Election Code. 25 Section 99. Effective date. This Act takes effect upon 26 becoming law.
