91_HB1054 LRB9104347KSks 1 AN ACT to amend the Criminal Code of 1961 by changing 2 Section 33D-1. 3 Be it enacted by the People of the State of Illinois, 4 represented in the General Assembly: 5 Section 5. The Criminal Code of 1961 is amended by 6 changing Section 33D-1 as follows: 7 (720 ILCS 5/33D-1) (from Ch. 38, par. 33D-1) 8 Sec. 33D-1. Contributing to the delinquency of a 9 juvenile. (a) Contributing to the criminal delinquency of a 10 juvenile. Any person of the age of 21 years and upwards, who 11 with the intent to promote or facilitate the commission of a 12 felony, solicits, compels or directs any person under the age 13 of 17 years in the commission of such felony commits the 14 offense of contributing to the criminal delinquency of a 15 juvenile. 16 (b) Sentence. Contributing to the criminal delinquency 17 of a juvenile is a felony one grade higher than the offense 18 committed, except when the offense committed is first degree 19 murder or a Class X felony. When the offense committed is 20 first degree murder or a Class X felony, the penalty for 21 contributing to the criminal delinquency of a juvenile is the 22 same as the penalty for first degree murder or a Class X 23 felony, respectively. 24 (Source: P.A. 85-906.)
