1 AMENDMENT TO HOUSE BILL 242
2 AMENDMENT NO. . Amend House Bill 242 by replacing
3 the title with the following:
4 "AN ACT to amend the Firearm Owners Identification Card
5 Act by changing Section 13.1."; and
6 by replacing everything after the enacting clause with the
7 following:
8 "Section 5. The Firearm Owners Identification Card Act
9 is amended by changing Section 13.1 as follows:
10 (430 ILCS 65/13.1) (from Ch. 38, par. 83-13.1)
11 Sec. 13.1. Local regulation.
12 (a) The provisions of any ordinance enacted by any
13 municipality which requires registration or imposes greater
14 restrictions or limitations on the acquisition, possession
15 and transfer of firearms, other than rifles and shotguns,
16 firearms than are imposed by this Act, are not invalidated or
17 affected by this Act.
18 (b) A unit of local government, including a home rule
19 unit, may not regulate the acquisition, possession,
20 transportation, storage, purchase, selling, or otherwise
21 dealing in rifles and shotguns and may not regulate

1 ammunition, components, accessories, or accoutrements of
2 rifles and shotguns. It is declared to be the public policy
3 of this State that regulation of the acquisition, possession,
4 transportation, storage, purchase, selling, or otherwise
5 dealing in rifles and shotguns and the regulation of
6 ammunition, components, accessories, or accoutrements of
7 rifles and shotguns is an exclusive State power or function.
8 Such power or function shall not be exercised concurrently,
9 either directly or indirectly by any unit of local
10 government, including home rule units. This subsection (b) is
11 a denial and limitation of home rule powers and functions
12 under subsection (h) of Section 6 of Article VII of the
13 Illinois Constitution.
