Senate Sponsors: JACOBS. Short description: IMPOUNDED VEH-LIENHOLDERS RTS Synopsis of Bill as introduced: Amends the Illinois Vehicle Code and the Labor and Storage Lien (Small Amount) Act. Provides that a vehicle impounded for the driver's failure to meet the mandatory insurance requirements may be released to a lienholder or secured party whose right, title, and interest is on record with the Secretary of State and who can show that the lien is bona fide and was created without knowledge that the vehicle was used or to be used in commission of the offense charged. Provides that notice of the impoundment shall be sent by certified mail to the registered owner, lienholder, and other legally entitled persons. Provides that if a motor vehicle is delivered to a lienor and not redeemed by a lawful possessor within 30 days, the lienor shall, within 45 days of delivery of a motor vehicle to him or her, serve notice of his or her claim to the motor vehicle by certified mail to each lienholder on the certificate of title. Provides that any lienholder shall be entitled to redeem the motor vehicle by paying the lienor's charges. Provides that notice of a sale of an unredeemed motor vehicle shall be given by certified mail, return receipt requested, to each lienholder shown on the certificate of title.
