To the general provision that a person who has been a patient of a mental institution within the past 5 years may be denied a FOID card, makes an exception for a certified, sworn law enforcement official who has been certified as being fit for duty by a physician licensed to practice medicine in all of its branches and who has been certified as being fit for duty to the Director of State Police by the chief law enforcement executive of the law enforcement agency by which the official is employed. Effective immediately. HOUSE AMENDMENT NO. 1. Deletes reference to: 430 ILCS 65/8 Adds reference to: 720 ILCS 5/9-1 from Ch. 38, par. 9-1 Deletes everything. Amends the Criminal Code of 1961. Provides that it is an aggravating factor in sentencing for first degree murder that the murdered individual was subject to an order of protection and the murder was committed by a person against whom an order of protec- tion was issued under the Illinois Domestic Violence Act of 1986. HOUSE AMENDMENT NO. 2. Provides that the aggravating factor in sentencing for first degree murder of a person subject to an order of protection applies only if the murder was committed by a person against whom the same order of protection was issued.
