House Sponsors: KUBIK-CURRIE. Short description: FOIA-COPYING COST Synopsis of Bill as introduced: Amends the Freedom of Information Act. Provides that, notwithstanding any other provision of law, the fee for reproducing any public record, regardless of the format of the record, shall not exceed the actual cost of reproduction. Deletes an obsolete cross-reference. Effective immediately. HOUSE AMENDMENT NO. 2. Adds reference to: 5 ILCS 140/7 from Ch. 116, par. 207 5 ILCS 140/7.2 new Deletes everything. Amends the Freedom of Information Act. Provides that fees charged for copying and reproducing a record shall not exceed the actual cost of reproduction and certification, regardless of the format of the record (now shall not exceed the actual cost of reproduction and certification). Defines "actual cost". Provides that certain information concerning the arrest of an individual or the issuance of a summons to an individual shall be available for inspection and copying. Provides that some of the information may be withheld if disclosure would (i) interfere with pending or actually and reasonably contemplated law enforcement proceedings; (ii) endanger the life or physical safety of law enforcement or correctional personnel or any other person; or (iii) compromise the security of any correctional facility. Provides that information identifying witnesses to traffic accidents, traffic accident reports, and rescue reports may be disclosed, except in a case for which a criminal investigation is ongoing, without constituting a clearly unwarranted invasion of personal privacy (now without constituting a clearly unwarranted per se invasion of personal privacy).
