Short description: 
CRIM PRO-FORENSIC DNA TESTING                                              

Synopsis of Bill as introduced:
        Amends the Code of Criminal Procedure of 1963.  Makes grammatical      
   changes  in  Section  construing  singular,  plural,  masculine,   and      
   feminine terms.                                                             
          FISCAL NOTE (Dpt. Corrections)                                       
          HB2138 has no fiscal or prison population impact on DOC.             
          CORRECTIONAL NOTE                                                    
          No change from DOC fiscal note.                                      
        HOUSE AMENDMENT NO. 1.                                                 
          Deletes reference to:                                                
          725 ILCS 5/102-3                                                     
          Adds reference to:                                                   
          725 ILCS 5/116-3 new                                                 
          730 ILCS 5/3-6-3                from Ch. 38, par. 1003-6-3           
          735 ILCS 5/2-1401               from Ch. 110, par. 2-1401            
        Deletes the title  and  everything  after  the  enacting  clause.      
   Amends  the  Code  of  Criminal Procedure of 1963, the Unified Code of      
   Corrections, and  the  Code  of  Civil  Procedure.   Provides  that  a      
   defendant  may  make  a motion before the trial court that entered the      
   judgment of conviction in his or  her  case  for  the  performance  of      
   fingerprint  or  forensic  DNA testing on evidence that was secured in      
   relation to the tests which resulted in  the  defendant's  conviction,      
   but  which was not subject to the testing because it was not available      
   at the time of trial.    Provides  that  sanctions  against  frivolous      
   lawsuits  apply  to these motions if they meet the criteria applicable      
   to those sanctions.
