Senate Sponsors: KARPIEL-CARROLL-BOWLES-PARKER Short description: ADOPTION-DRUG ADDICTED BABIES Synopsis of Bill as introduced: Amends the Adoption Act in provisions defining unfit parent to include a biological mother whose child at birth had blood or urine containing any amount of a controlled substance as defined in the Illinois Controlled Substances Act, excluding medical treatment administered to the mother or newborn, and who is the biological mother of at least one other child who has been adjudicated a neglected minor under provisions of the Juvenile Court Act of 1987 regarding children born with evidence of controlled substances in their blood or urine, and who thereafter had an opportunity to par- ticipate in a drug counseling, treatment, and rehabilitation program. Effective immediately. HOUSE AMENDMENT NO. 1. Provides that a parent will be found unfit if any amount of a controlled substance is found in the child's meconium, in addition to his or her blood or urine, and the other conditions listed are met. STATE MANDATES FISCAL NOTE, H-AM 2 HB 951, amended by H-am 2, fails to create a State mandate. JUDICIAL NOTE, H-AM 1 & 2 The bill would not increase the need for the number of judges. HOUSE AMENDMENT NO. 2. In provisions concerning the determination of whether a mother is unfit, provides that the mother must have had an opportunity to enroll and participate in a clinically appropriate substance abuse counsel- ing, treatment and rehabilitation program, rather than an opportunity to participate in a drug counseling, treatment and rehabilitation pro- gram.
