Removes from the definition of "care" overhead expense and maintenance of records of lot ownership, transfers, and burials. Provides that the definition of "care" does not include the compensation of employees the preponderance of whose duties do not involve the maintenance of the cemetery. Provides that a cemetery authority owning, operating, controlling, or managing a privately operated cemetery shall make application for a license within 30 days whenever it is newly organized and desires to be licensed to accept care funds or whenever there is a sale or transfer of a controlling interest. SENATE AMENDMENT NO. 1. Deletes reference to: 760 ILCS 100/9 Adds reference to: 760 ILCS 100/15b Provides that, to the extent surplus income from the care fund is available, the definition of "care" includes the payment of overhead expenses and the maintenance of records of lot ownership, transfers, and burials. Removes the provision that excludes from the definition of "care" compensation of employees the preponderance of whose duties do not include the maintenance of the cemetery. Removes the provision that requires a cemetery authority to make application for a license within 30 days. Further amends the Cemetery Care Act. In provisions concerning a cemetery authority sale or transfer, provides that, when the Comptroller issues a new cemetery care license upon application of the newly controlled corporation or partnership, the license must be applied for within 30 days of the anticipated date of the sale or transfer. Adds an immediate effective date. STATE MANDATES ACT FISCAL NOTE SB 1244 fails to create a State mandate.
