COULSON-BIGGERT-SCOTT-KOSEL-WOOD, SCHOENBERG AND RUTHERFORD. (HAWKINSON-PARKER) New Act Creates the International Commercial Arbitration Act. Provides that the Act applies to international commercial arbitration in the State of Illinois. Provides for the receipt of written communications, the waiver of the right to object, the extent of court intervention, functions of a court, arbitration agreements, the composition of an arbitral tribunal, the jurisdiction of an arbitral tribunal, the conduct of arbitral proceedings, and the making of an award and the termination of proceedings. Effective immediately. HOUSE AMENDMENT NO. 1. Provides that an arbitration is international if the parties to an arbitration agreement have, at the time of the conclusion of execution of that agreement (instead of at the time of the conclusion of that agreement), their places of business in different countries. Provides that an arbitration is international if the place where the predominant part (instead of a substantial part) of the obligations of the commercial relationship is to be performed is situated outside the country or countries (instead of country) in which the parties have their places of business. Provides that provisions that prohibit certain decisions from being subject to appeal shall not preclude the parties from raising any ground for setting aside or refusing to recognize or enforce an arbitral award to the extent otherwise permitted under applicable federal law. Provides that provisions concerning an expert being appointed by an arbitral tribunal apply unless objected to by one or both parties (instead of unless otherwise agreed to by the parties). Makes other changes. JUDICIAL NOTE, AMENDED No increase in the need for the number of judges in the State. FISCAL NOTE, AMENDED (Administrative Office of Ill. Courts) No fiscal impact on the Judicial Branch. 97-10-22 H FILED WITH CLERK 97-10-22 H ADDED AS A JOINT SPONSOR BIGGERT 97-10-28 H FIRST READING 97-10-28 H REFERRED TO HOUSE RULES COMMITTEE RULES 97-11-13 H ASSIGNED TO COMMITTEE JUD-CIVIL LAW 98-01-02 H RE-REFERRED TO RULES COMM/RULE 19(B) RULES HRUL 98-01-27 H ADDED AS A CO-SPONSOR SCOTT 98-01-27 H ADDED AS A CO-SPONSOR SCULLY 98-02-03 H ASSIGNED TO COMMITTEE JUD-CIVIL LAW 98-02-03 H ADDED AS A CO-SPONSOR KOSEL 98-02-03 H ADDED AS A CO-SPONSOR WOOD 98-02-19 H AMENDMENT NO. 01-JUD-CIVIL LAW H 98-02-19 H ADOPTED 98-02-19 H DO PASS AMENDED/SHORT DEBATE 011-000-000 HJUA 98-02-19 H PLACED CALENDAR 2ND READING-SHORT DEBATE 98-02-24 H JUDICIAL NOTE FILED AS AMENDED 98-02-24 H FISCAL NOTE FILED AS AMENDED 98-02-24 H CALENDAR ORDER 2ND READING-SHORT DEBATE 98-02-26 H ADDED AS A CO-SPONSOR SCHOENBERG 98-03-19 H SECOND READING-SHORT DEBATE 98-03-19 H PLCD CAL ORDER 3RD READING-SHORT DEBATE 98-03-24 H ADDED AS A CO-SPONSOR RUTHERFORD 98-03-24 H THIRD READING/SHORT DEBATE/PASSED 116-000-000 98-03-25 S ARRIVE IN SENATE 98-03-25 S PLACED CALENDAR ORDER OF FIRST READING 98-03-25 S CHIEF SPONSOR PARKER 98-03-25 S FIRST READING 98-03-25 S REFERRED TO SENATE RULES COMMITTEE RULES 98-03-25 S SPONSOR REMOVED PARKER 98-03-25 S ALTERNATE CHIEF SPONSOR CHANGED TO HAWKINSON 98-03-25 S ADDED AS A CHIEF CO-SPONSOR PARKER 98-04-01 S ASSIGNED TO COMMITTEE JUDICIARY 98-04-22 S DO PASS 008-000-000 SJUD 98-04-22 S PLACED ON CALENDAR ORDER OF 2ND READING 98-04-23 98-04-28 S SECOND READING 98-04-28 S PLACED ON CALENDAR ORDER OF 3RD READING 98-04-29 98-04-29 S THIRD READING - PASSED 059-000-000 98-04-29 H PASSED BOTH HOUSES 98-05-28 H SENT TO THE GOVERNOR 98-07-24 H GOVERNOR APPROVED 98-07-24 H EFFECTIVE DATE 98-07-24 98-07-24 H PUBLIC ACT.............................. 90-0631 END OF INQUIRY Full Text Bill Summary
