STEPHENS-HOLBROOK-DAVIS,STEVE. 105 ILCS 5/10-20.12b Amends the School Code. Deletes a provision which includes as a form of legal custody used in determining a pupil's district of residence custody exercised by an adult who demonstrates that he has assumed and exercises legal responsibility for the pupil and provides the pupil with a regular fixed night-time abode for purposes other than to have access to the educational programs of a school district. Also replaces a provision that provides that the residence of a person who has legal custody is deemed to be the residence of the pupil with language that provides that the residence of a pupil is deemed to be the residence of a person who has legal custody of the pupil. STATE MANDATES FISCAL NOTE (State Board of Ed.) It is assumed that since the burden of proof would become more stringent, fewer students will be able to establish legal res- idency outside of their "true" districts of residence.This will have a positive fiscal effect on individual districts that no longer have to serve particular students tuition-free. The size of the effect will vary from district to district and is impos- sible to calculate since no data are collected on the number and whereabouts of students in this situation.
