      70 ILCS 705/16.11         from Ch. 127 1/2, par. 37.11
          Amends  the  Illinois  Municipal  Code   and   the   Fire
      Protection  District  Act.    Provides  that  firefighters or
      police officers who are candidates for promotion  shall  have
      served  2 years at their current rank in order to participate
      in the promotional examination process.  Provides for the use
      of weighted exams.  Provides that promoted  candidates  shall
      serve a probationary term of 12 months.  Provides that during
      the  probationary  term  the  board,  at  its discretion, may
      terminate  the  candidate's  probationary  status   and   the
      candidate shall revert to his or her former rank.

 1        AN  ACT  in relation to firefighters and police officers,
 2    amending named Acts.
 3        Be it enacted by the People of  the  State  of  Illinois,
 4    represented in the General Assembly:
 5        Section  5.   The  Illinois  Municipal Code is amended by
 6    changing Section 10-2.1-15 as follows:
 7        (65 ILCS 5/10-2.1-15) (from Ch. 24, par. 10-2.1-15)
 8        Sec. 10-2.1-15. Promotions; merit, seniority.  The board,
 9    by its rules, shall provide for promotion  in  the  fire  and
10    police  departments  on  the  basis  of ascertained merit and
11    seniority in service and examination, and  shall  provide  in
12    all  cases,  where it is practicable, that vacancies shall be
13    filled by promotion. All examinations for promotion shall  be
14    competitive  among  the  qualified  such  members of the next
15    lower rank as desire to  submit  themselves  to  examination.
16    Candidates  for  promotion  shall  have served for 2 years in
17    their current rank on the date established  for  the  written
18    examination  in  order  to  qualify  for participation in the
19    examination process.  The  examination  shall  consist  of  a
20    series  of  component  tests.   Each  test shall be worth 100
21    points in total value.  The component tests shall be assigned
22    a  percentage weight to be used to  calculate  a  candidate's
23    total  weighted  score  as  follows:  (i) written examination
24    shall be 50%; (ii) oral interview/assessment center shall  be
25    35%; and (iii) merit and efficiency shall be 15%.
26        The  criteria  used to establish the merit and efficiency
27    score shall be developed and  provided by the  chief  of  the
28    fire  department  or  police department.  Each component test
29    score shall be multiplied by the percentage  assigned  to  it
30    with  the  results  of each  component test added together to
31    create the total weighted  score  for  each  candidate.   The

 1    total weighted score shall be adjusted by adding to it points
 2    for  seniority  and  veteran's  preference.  Seniority points
 3    shall be awarded to each candidate on the basis of 1/2 point,
 4    not to exceed a total of 5 points,  for  each  full  year  of
 5    service   as   a   firefighter   or  police  officer  on  the
 6    municipality's fire  department  or  police  department.    A
 7    candidate's  seniority  shall  be  calculated on the date the
 8    written examination is  administered.   Veteran's  preference
 9    points shall be awarded under Section 10-2.1-11 of this Act.
10        All  promotions  shall  be  made  from  the  3 having the
11    highest rating, and where there are less than 3 names on  the
12    promotional  eligible  register,  as  originally  posted,  or
13    remaining   thereon   after   appointments   have  been  made
14    therefrom, appointments to fill existing vacancies  shall  be
15    made  from  those  names or name remaining on the promotional
16    register except that promotions made in any municipality with
17    more than 130,000 but less than 2,000,000 population  may  be
18    made from the 7 members having the highest rating. The method
19    of  examination  and  the  rules  governing  examinations for
20    promotion shall be the same as provided  for  applicants  for
21    original  appointment, except that original appointments only
22    shall be on probation, as provided by the rules.   Candidates
23    promoted under this Section shall serve a  probationary  term
24    of  12  months.   During the probationary term, the board, at
25    its discretion, may terminate the candidate's    probationary
26    status  and  the  candidate shall revert to his or her former
27    rank.
28        The board shall strike off the names  of  candidates  for
29    promotional  appointment after they have remained thereon for
30    more than 3 years, provided there is no vacancy existing that
31    which can be filled from the promotional register.

33        Section 10.  The Fire Protection District Act is  amended

 1    by changing Section 16.11 as follows:

 3        Sec.  16.11.  Promotions.  The board, by its rules, shall
 4    provide for promotion in the fire department on the basis  of
 5    ascertained  merit  and seniority in service and examination,
 6    and shall provide in all cases, where it is practicable, that
 7    vacancies shall be filled by promotion.  All examinations for
 8    promotion shall  be  competitive  among  the  qualified  such
 9    members of the next lower rank as desire to submit themselves
10    to  examination.  Candidates  for promotion shall have served
11    for 2 years in their current rank on the    date  established
12    for   the   written  examination  in  order  to  qualify  for
13    participation in the  examination process.   The  examination
14    shall  consist  of  a  series of component tests.  Each  test
15    shall be worth 100 points  in  total  value.   The  component
