1 AMENDMENT TO SENATE BILL 1707
2 AMENDMENT NO. . Amend Senate Bill 1707, AS AMENDED,
3 with reference to page and line numbers of House Amendment
4 No. 1, on page 1, line 15, by deleting "or acreage"; and
5 on page 4, line 2, by inserting "months" after "4"; and
6 on page 19, lines 25 and 26, by replacing "the facility
7 lagoon" with "a the lagoon"; and
8 on page 19, line 26, by inserting "The livestock waste
9 storage capacity for a facility other than a lagoon must be
10 at least 180 days." after "days."; and
11 on page 25, lines 22 and 23, by replacing "the seasonal high
12 water table is" with "aquifer material is found"; and
13 on page 26, line 5, by inserting after "operator." the
14 following:
15 "There shall be no liability under this Section for any
16 financial institution as that term is defined in Section 2 of
17 the Illinois Banking Act nor to any other federally chartered
18 or regulated financial institution that has acquired an
19 ownership interest in a livestock waste handling facility or
20 in livestock through foreclosure, receivership, or otherwise
21 under the terms of a security interest held by the financial

1 institution or whose ownership interest, control, or
2 specifications arise through the terms of an extension of
3 credit made by the financial institution to the owner or
4 operator of a livestock waste handling facility or livestock.
5 There shall also be no liability under this Section for a
6 trustee, executor, administrator, guardian, receiver,
7 conservator, or other person whose ownership interest,
8 control, or specification arises in a fiduciary capacity.".
