Prohibits a person from intentionally standing upon, using, or occupying the public way to solicit any unlawful business and from interfering with or impeding a pedestrian or anyone in a vehicle on the highway for the purpose of soliciting an unlawful business. Provides that a first offense is a Class C misdemeanor, a second offense, a Class B misdemeanor, and a third offense, a Class A misdemeanor. In addition to other sentences, the court shall require the offender to perform community service of not more than 200 hours, if community service is available in the jurisdiction. LRB9010658RCks LRB9010658RCks 1 AN ACT to amend the Illinois Vehicle Code by adding 2 Section 11-1416.5. 3 Be it enacted by the People of the State of Illinois, 4 represented in the General Assembly: 5 Section 5. The Illinois Vehicle Code is amended by 6 adding Section 11-1416.5 as follows: 7 (625 ILCS 5/11-1416.5 new) 8 Sec. 11-1416.5. Soliciting unlawful business. 9 (a) No person may intentionally: (1) stand upon, use, or 10 occupy the public way to solicit any unlawful business; or 11 (2) interfere with or impede any pedestrian or anyone in a 12 vehicle on the highway for the purpose of soliciting any 13 unlawful business. 14 (b) For purposes of this Section: 15 (1) "Unlawful business" means any exchange of goods 16 or services for money or anything of value, when the 17 nature of the goods or services, or the exchange of the 18 goods or services is unlawful. Unlawful business 19 includes, but is not limited to, prostitution or the 20 illegal sale of cannabis or controlled substances. 21 (2) "Soliciting" may be by words, gestures, symbols 22 or any similar means. 23 (c) A person who violates this Section is guilty of a 24 Class C misdemeanor for a first offense, a Class B 25 misdemeanor for a second offense, and a Class A misdemeanor 26 for a third or subsequent offense. In addition to any other 27 sentence that may be imposed for a violation of this Section, 28 the court shall order a person convicted of or placed on 29 supervision for a violation of this Section to perform 30 community service for not more than 200 hours, if community 31 service is available in the jurisdiction. -2- LRB9010658RCks 1 Section 99.
