1 AN ACT to amend the Code of Criminal Procedure of 1963 by
2 changing Section 108-2.
3 Be it enacted by the People of the State of Illinois,
4 represented in the General Assembly:
5 Section 5. The Code of Criminal Procedure of 1963 is
6 amended by changing Section 108-2 as follows:
7 (725 ILCS 5/108-2) (from Ch. 38, par. 108-2)
8 Sec. 108-2. Custody and disposition of things seized.
9 An inventory of all instruments, articles or things
10 seized on a search without warrant shall be given to the
11 person arrested and a copy thereof delivered to the judge
12 before whom the person arrested is taken, and thereafter,
13 such instruments, articles or things shall be handled and
14 disposed of in accordance with Sections 108--11 and 108--12
15 of this Code. If the person arrested is released without a
16 charge being preferred against him or her all instruments,
17 articles or things seized, other than contraband, shall be
18 returned to him upon release.
