90_SB1687 New Act Creates the Internet Gambling Limitation Act. Prohibits using the Internet to conduct gambling. Provides that a violation is a Class A misdemeanor. LRB9010863LDgc LRB9010863LDgc 1 AN ACT to create the Internet Gambling Limitation Act. 2 Be it enacted by the People of the State of Illinois, 3 represented in the General Assembly: 4 Section 1. Short title. This Act may be cited as the 5 Internet Gambling Limitation Act. 6 Section 5. Definitions. For the purposes of this Act: 7 "Internet" means an interactive computer service or 8 system or an information service, system, or access software 9 provider that provides or enables computer access by multiple 10 users to a computer server, and includes, but is not limited 11 to, an information service, system, or access software 12 provider that provides access to a network system commonly 13 known as the Internet, or any comparable system or service 14 and also includes, but is not limited to, a World Wide Web 15 page, newsgroup, message board, mailing list, or chat area on 16 any interactive computer service or system or other online 17 service. 18 "Gambling" means any game of chance upon which a wager is 19 placed, regardless of whether that game of chance is 20 authorized by any law of this State, or the placing of a 21 wager on the outcome of a sporting event or other activity. 22 Section 10. Internet gambling prohibited; penalty. No 23 person may use the Internet to conduct gambling; to transmit 24 bets or wagers; to receive money or credit as the result of 25 gambling or placing bets or wagers; or to transmit or receive 26 information that is intended for use or assistance in 27 gambling. Any person who uses the Internet in violation of 28 this Section is guilty of a Class A misdemeanor. 29 Section 15. Actions not prohibited by this Act. This -2- LRB9010863LDgc 1 Act does not prohibit the use of the Internet (i) to transmit 2 or receive any information for use in news reporting of any 3 activity, event, or contest upon which wagers are placed; 4 (ii) to advertise, promote, or communicate information about 5 any lawful gambling or (iii) to conduct a bona fide business 6 transaction governed by federal securities law for the 7 purchase or sale of securities at a future date.
