Requires the Water Well and Pump Installation Contractors Licensing Board to consider recommendations of the Illinois Association of Groundwater Professionals regarding appointments to the Board. Provides that applicants for renewal licenses must fulfill certain continuing education requirements. LRB9009746LDdv LRB9009746LDdv 1 AN ACT to amend the Water Well and Pump Installation 2 Contractor's License Act by changing Sections 4, 6, 7, and 3 12. 4 Be it enacted by the People of the State of Illinois, 5 represented in the General Assembly: 6 Section 5. The Water Well and Pump Installation 7 Contractor's License Act is amended by changing Sections 4, 8 6, 7, and 12 as follows: 9 (225 ILCS 345/4) (from Ch. 111, par. 7105) 10 Sec. 4. License requirement. Subject to the provisions 11 of Section 3, no contractor shall drill a water well or 12 engage in the occupation of a water well contractor unless he 13 holds a valid license as a water well contractor issued by 14 the Department under this Act. Subject to the provisions of 15 Section 3, after January 1, 1972, no person shall drill a 16 water well, install or repair a water well pump or equipment, 17 or engage in the occupation of a Water Well and Pump 18 Installation Contractor unless he holds a valid license as a 19 Water Well and Pump Installation Contractor issued under this 20 Act. 21 Provided, however, that nothing in this Section or any 22 other statute or regulation of this State prohibits any 23 person from making a water well pump installation or engaging 24 in the business of connecting water pressure tanks to the 25 water supply systems of buildings or to pumps or pumping 26 units, so long as such person possesses either a valid 27 license as a water well pump installation contractor or a 28 water well and pump installation contractor issued under this 29 Actor has a valid license issued under the Illinois Plumbing30License Law. Any person holding a valid license under the 31 Illinois Plumbing License Law may apply and receive, without -2- LRB9009746LDdv 1 examination or fee, a water well pump installation contractor 2 license provided that all other requirements of this Act are 3 met. 4 (Source: P.A. 80-670.) 5 (225 ILCS 345/6) (from Ch. 111, par. 7107) 6 Sec. 6. Board. There is created in the Department the 7 Water Well and Pump Installation Contractors Licensing Board 8 which shall exercise its duties provided in this Act under 9 the supervision of the Department. The Board shall consist of 10 6 members, designated from time to time by the Director. Two 11 members shall be licensed water well contractors, two members 12 shall be licensed water well pump installation contractors, 13 and two members shall be licensed water well and pump 14 installation contractors. In making the appointments to the 15 Board, the Director shall consider the recommendation of the 16 Illinois Association of Groundwater ProfessionalsIllinois17Water Well Association. 18 The members of the Board shall be reimbursed for 19 necessary traveling expenses in accordance with travel 20 regulations prescribed by the Department of Finance. 21 The Board shall advise and aid the Director in: 22 (a) preparing subject matter for continuing 23 education sessions and examinations to test the knowledge 24 and skills of applicants for license in the construction, 25 installation and repair of water wells, well pumps, water 26 pressure storage tanks, connecting piping and related 27 appurtenances, including proper sealing of abandoned 28 water wells, and the rules and regulations of the 29 Department promulgated pursuant to the Illinois Pump 30 Installation Code Law and the Illinois Water Well 31 Construction Code Law; 32 (b) promulgating rulesand regulationsto govern 33 the number of hours of continuing education required for -3- LRB9009746LDdv 1 a continuing education session, examinations, hearings 2 for suspension or revocation of or refusal to issue or 3 renew a license, clarifying the law as it relates to 4 water well and pump installation contracting;.5 (c) holding examinations of applicants for license 6 at least once a year prior to November 1st in each year; 7 (d) holding hearings for the revocation or 8 suspension of, or refusal to issue, renew or reinstate 9 licenses; 10 (e) submitting recommendations to the Director from 11 time to time for the efficient administration of this 12 Act; 13 (f) grading all tests and examinations for licenses 14 and promptly reporting the results to the Director; and 15 (g) performing such other duties from time to time 16 prescribed by the Director. 17 (Source: P.A. 80-670.) 18 (225 ILCS 345/7) (from Ch. 111, par. 7108) 19 Sec. 7. Department duties. The Department shall: 20 (a) Fix and announce dates for examinations; 21 (b) Prepare forms for application for a water well 22 Contractor's license, a water well pump installation 23 contractor's license, and a water well drilling and pump 24 installation contractor's license, which application 25 shall state thereon the scope of the examination as set 26 forth in paragraph (a) of Section 6 of this Act; 27 (c) Prepare and issue license certificates to those 28 entitled thereto; 29 (d) With the aid of the Board, prescribe rules and 30 regulations for the conduct of examinations and 31 continuing education sessions; 32 (e) Prescribe rules for hearings to suspend, revoke 33 or reinstate licenses as provided in this Act; -4- LRB9009746LDdv 1 (f) Maintain and publish annually a roster showing 2 (1) the names and addresses of licensed water well 3 contractors, water well pump installation contractors, 4 and water well and pump installation contractors. The 5 Department may impose a fee for each roster which fee 6 shall be set forth in the rules and regulations. 7 The Department shall maintain a record in the 8 Springfield office showing (1) the names and addresses of 9 all registrants under this Act, (2) the dates of issuance 10 of the licenses, (3) the date and substance of the 11 charges set forth in any complaint for suspension or 12 revocation of any license, (4) the date and substance of 13 all petitions for reinstatement of licenses and (5) the 14 final order on such complaints and petitions. Upon 15 written request the Department in its discretion shall 16 make this information available to any registrant under 17 this Act. 18 (Source: P. A. 77-1626.) 19 (225 ILCS 345/12) (from Ch. 111, par. 7113) 20 Sec. 12. License renewal. All licenses issued under this 21 Act shall expire on January 31, next following the date of 22 issuance, except that a license issued after October 31 and 23 before January 31 shall expire on January 31 next occurring 24 after the license has been in effect for one year. A license 25 may be renewed for an ensuing license year without 26 examination by making application therefor and paying the 27 prescribed fee at least 30 days prior to the expiration date 28 of the current license and such application shall extend the 29 period of validity of the current license until a new license 30 is received or the Department refuses to issue a new license 31 under the provisions of this Act. A license issued under 32 this Act which has expired may be reinstated immediately upon 33 payment of the reinstatement fee, provided, however, not more -5- LRB9009746LDdv 1 than 3 years have elapsed since the date of expiration. A 2 license which has expired for more than 3 years may be 3 restored only by payment of the restoration fee and 4 submitting evidence satisfactory to the Department of the 5 current qualifications and fitness of the registrant, and by 6 successfully passing the examination for a Water Well 7 Contractor, Water Well Pump Installation Contractor, or Water 8 Well and Pump Installation Contractor's License. 9 Beginning January 1, 2000, a contractor seeking a renewal 10 license under this Act shall provide substantial evidence 11 that he or she has attended at least one continuing education 12 session in the preceding 2 years in order to qualify for a 13 renewal license. 14 (Source: P.A. 84-489.)
