90_SB1392 Amends the Criminal Code of 1961. Provides that a person who commits the offense of intimidation in which the victim of the intimidation is a Block Club member or a community policing person is guilty of aggravated intimidation. Effective immediately. LRB9008870RCks LRB9008870RCks 1 AN ACT to amend the Criminal Code of 1961 by changing 2 Section 12-6.2. 3 Be it enacted by the People of the State of Illinois, 4 represented in the General Assembly: 5 Section 5. The Criminal Code of 1961 is amended by 6 changing Section 12-6.2 as follows: 7 (720 ILCS 5/12-6.2) 8 Sec. 12-6.2. Aggravated intimidation. 9 (a) Any streetgang member who commits the offense of 10 intimidation in furtherance of the activities of an organized 11 gang commits the offense of aggravated intimidation. 12 (a-5) A person who commits the offense of intimidation 13 in which the victim of the intimidation is a Block Club 14 member or a community policing person commits the offense of 15 aggravated intimidation. 16 (b) Sentence. Aggravated intimidation is a Class 1 17 felony. 18 (c) For the purposes of this Section: 19 (1) "Block Club member" means a person who is a 20 member in a voluntary association consisting of residents 21 of contiguous residences in a specifically defined 22 geographic area organized to enhance the quality of life 23 in the area by organizing such activities including, but 24 not limited to, neighborhood watches, community clean-up, 25 or other related neighborhood activities. 26 (2) "Community policing person" means a person 27 performing any work or duties that are prescribed by, 28 guided by, or directed by members of a law enforcement 29 agency under any community policing program established 30 by and conducted under the auspices of a law enforcement 31 agency in which citizens act under the guidance or -2- LRB9008870RCks 1 direction of the law enforcement agency to reduce or 2 prevent crime in a given geographic area.,3 (3) "Streetgang", "streetgangsteetgangmember", 4 and "organized gang" have the meanings ascribed to them 5 in Section 10 of the Illinois Streetgang Terrorism 6 Omnibus Prevention Act. 7 (Source: P.A. 89-631, eff. 1-1-97; revised 7-7-97.) 8 Section 99. Effective date. This Act takes effect upon 9 becoming law.
