90_SB1266 720 ILCS 5/11-20.3 new Amends the Criminal Code of 1961. Provides that it is a Class 4 felony to post the name, address, telephone number, or any other identifying information concerning a child under 18 years of age in any context that is associated with the display, distribution, or promotion of child pornography, harmful material, or obscene material on the Internet or an online service. Effective immediately. LRB9007700RCks LRB9007700RCks 1 AN ACT to amend the Criminal Code of 1961 by adding 2 Section 11-20.3. 3 Be it enacted by the People of the State of Illinois, 4 represented in the General Assembly: 5 Section 5. The Criminal Code of 1961 is amended by 6 adding Section 11-20.3 as follows: 7 (720 ILCS 5/11-20.3 new) 8 Sec. 11-20.3. Posting child identifying information on 9 the Internet. 10 (a) A person commits the offense of posting child 11 identifying information on the Internet when he or she 12 knowingly posts, disseminates, or otherwise makes available 13 the name, address, or telephone number of, or any other 14 identifying information concerning, a child under 18 years of 15 age in any context that is associated with the display, 16 distribution, or promotion of child pornography, harmful 17 material, or obscene material on the Internet or an online 18 service, including but not limited to a World Wide Web page, 19 newsgroup, message board, mailing list, or chat area on the 20 Internet or an online service that displays, distributes, or 21 promotes child pornography, harmful material, or obscene 22 material. 23 (b) Sentence. Posting child identifying information on 24 the Internet is a Class 4 felony. 25 (c) Definitions. In this Section: 26 (1) "Child pornography" has the meaning ascribed to 27 it in Section 11-20.1 of this Code. 28 (2) "Harmful material" has the meaning ascribed to 29 it in Section 11-21 of this Code. 30 (3) "Obscene" has the meaning ascribed to it in 31 Section 11-20 of this Code. -2- LRB9007700RCks 1 (4) "Child pornography", "harmful material", or 2 "obscene" also means information that constitutes child 3 pornography, harmful material, or obscene material under 4 federal law or laws of another state that are 5 substantially similar to the child pornography, harmful 6 material, or obscenity laws of this State. 7 Section 99. Effective date. This Act takes effect upon 8 becoming law.
