 1                    AMENDMENT TO SENATE BILL 1210
 2        AMENDMENT NO.     .  Amend Senate Bill 1210 by  replacing
 3    the title with the following:
 4        "AN  ACT  to  amend  the  Property  Tax  Code by changing
 5    Section 27-55."; and
 6    by replacing everything after the enacting  clause  with  the
 7    following:
 8        "Section 5.  The Property Tax Code is amended by changing
 9    Section 27-55 as follows:
10        (35 ILCS 200/27-55)
11        Sec. 27-55.  Objection petition.  If a petition signed by
12    at  least  51%  of  the  electors residing within the special
13    service area and by at least 51% of the owners of  record  of
14    the  land  included  within  the  boundaries  of  the special
15    service area is filed with  the  municipal  clerk  or  county
16    clerk, as the case may be, within 60 days following the final
17    adjournment  of the public hearing, objecting to the creation
18    of the special service district, the enlargement of the area,
19    the levy or imposition of a tax or the issuance of bonds  for
20    the  provision  of  special  services  to  the  area, or to a

 1    proposed increase in the tax rate, the district shall not  be
 2    created  or  enlarged,  or  the  tax  shall  not be levied or
 3    imposed nor the rate increased, or no bonds  may  be  issued.
 4    Notwithstanding any provision to the contrary, a signature on
 5    the  petition  may not be revoked after the petition has been
 6    filed unless the revocation is  in  writing,  signed  by  the
 7    person   whose   signature   appears  on  the  petition,  and
 8    subscribed and sworn to before a notary public.  The  subject
 9    matter  of the petition shall not be proposed relative to any
10    signatories of the petition within the next  2  years.   Each
11    resident  of  the  special service area registered to vote at
12    the time of the  public  hearing  held  with  regard  to  the
13    special  service  area  shall be considered an elector.  Each
14    person in whose name legal title to land included within  the
15    boundaries  of  the special service area is held according to
16    the records of the county in which the land is located  shall
17    be  considered an owner of record.  Owners of record shall be
18    determined at the time of the public hearing held with regard
19    to a special service area.  Land owned in the name of a  land
20    trust, corporation, estate or partnership shall be considered
21    to have a single owner of record.

23        Section  99.  Effective date.  This Act takes effect upon
24    becoming law.".
