The Criminal Code of 1961 is amended by adding 6 Article 26.5 as follows: 7 (720 ILCS 5/Art. 26.5 heading new) 8 ARTICLE 26.5. ELECTRONIC MAIL MISUSE 9 (720 ILCS 5/26.5-5 new) 10 Sec. 26.5-5. Electronic mail misuse. 11 (a) It is unlawful for any person to use electronic mail 12 or similar electronic communication: 13 (1) In a manner reasonably to be expected to annoy, 14 abuse, torment, harass, or embarrass one or more persons; 15 (2) With intent to annoy, abuse, torment, harass, 16 or embarrass one or more persons; or 17 (3) For any comment, request, suggestion, or 18 proposal that is obscene, lewd, lascivious, filthy, or 19 indecent. 20 (b) Sentence. Any person violating this Section is 21 guilty of a Class 4 felony.
