305 ILCS 5/10-17.10 new
Amends the Illinois Public Aid Code. Provides that the
Department of Public Aid may adopt rules for the
certification to other states' child support enforcement
agencies of past due support owed by responsible relatives
under a support order. Provides that the rules shall give
affected responsible relatives notice and an opportunity to
be heard, and that final decisions of the Department may be
received only under the Administrative Review Law. Effective
immediately.

1 AN ACT to amend the Illinois Public Aid Code by adding
2 Section 10-17.10.
3 Be it enacted by the People of the State of Illinois,
4 represented in the General Assembly:
5 Section 5. The Illinois Public Aid Code is amended by
6 adding Section 10-17.10 as follows:
7 (305 ILCS 5/10-17.10 new)
8 Sec. 10-17.10. Requests to other states for
9 administrative enforcement. The Illinois Department may
10 provide by rule for certification to other states' child
11 support enforcement agencies of past due support owed by
12 responsible relatives under a support order entered by a
13 court or administrative body of this or any other state on
14 behalf of resident or non-resident persons. The purpose of
15 certification shall be to request the other states'
16 assistance in administrative enforcement of the support
17 orders. The rule shall provide for notice to and an
18 opportunity to be heard by the responsible relative affected
19 and any final administrative decision rendered by the
20 Illinois Department shall be reviewed only under and in
21 accordance with the Administrative Review Law.
22 Section 99. Effective date. This Act takes effect upon
23 becoming law.
