90_SB0692 30 ILCS 805/8a new Amends the State Mandates Act. Provides that before action in either chamber on legislation that could constitute final action on that legislation in that chamber, a committee hearing considering a mandate exemption or exclusion shall be held on each bill that, as introduced, contains an exemption or exclusion, and on each amendment, conference committee report, joint action motion, or amendatory veto motion that would add an exemption or exclusion. Requires that notice of the hearing be posted publicly and that the text of the legislation be made available to the public at least 6 days before the hearing. Requires that a fiscal note shall be filed at least 2 days before the hearing identifying the additional costs imposed by the mandate and whether all or a part of the additional costs will be funded by a new revenue source and, if not, then what existing funds now used for other purposes will need to be used to fund the mandate. Requires a legislative finding in the language of the legislation that the mandates exemption or exclusion is necessary and a statement explaining the reason for exempting or excluding the legislation from the Act. The State Mandates Act is amended by adding 6 Section 8a as follows: 7 (30 ILCS 805/8a new) 8 Sec. 8a. Procedural requirements; mandate exemptions. 9 Each bill, amendment, conference committee report, joint 10 action motion, and amendatory veto motion that contains an 11 express exclusion or exemption from the applicability of this 12 Act is subject to the following requirements: 13 (1) Before any action by either chamber on 14 legislation that could constitute final action on that 15 legislation in that chamber, a committee hearing 16 considering a mandate exclusion or exemption shall be 17 held on each bill that, as introduced, contains an 18 exclusion or exemption or each amendment, conference 19 committee report, joint action motion, or amendatory veto 20 motion that would add an exclusion or exemption to the 21 legislation. At least 6 days before the committee 22 hearing, notice of the hearing shall be posted publicly 23 and the text of the legislation shall be made available 24 to the public. 25 (2) At least 2 days before consideration of the 26 legislation by the committee, a fiscal note shall be 27 filed. The fiscal note shall identify the additional 28 costs imposed by the mandate and whether all or a part of 29 the additional costs will be funded by a new revenue 30 source and, if not, then what existing funds now used for 31 other purposes will need to be used to fund the mandate. -2- LRB9001211KDks 1 (3) Each bill that, as introduced, contains a 2 mandate exclusion or exemption and each amendment, 3 conference committee report, joint action motion, and 4 amendatory veto motion that would add a mandate exclusion 5 or exemption shall contain (i) a legislative finding that 6 exemption or exclusion from the Act is necessary and (ii) 7 a statement explaining the reasons for exempting or 8 excluding the legislation from the Act.
