90_SB0637 New Act Creates the Fund Education First Act. Beginning with fiscal year 1998, and in each fiscal year thereafter, provides that until the amount appropriated from general funds revenues for elementary and secondary education for the fiscal year represents 50% of the total revenues that the State Superintendent of Education estimates are available from local, State, and federal sources for elementary and secondary education for that fiscal year, the amount appropriated by the General Assembly from general funds revenues for elementary and secondary educational programs for that fiscal year shall be at least equal to the sum of (1) 50% of the growth in general funds revenues that fiscal year, plus (2) the total amount appropriated from general funds revenues for elementary and secondary educational programs during the preceding fiscal year. Establishes a minimum funding level for elementary and secondary educational programs from general funds revenues for subsequent fiscal years. Requires the Governor, beginning with fiscal year 1999, to include in the annual budget an allocation for education that conforms to the provisions of the Fund Education First Act. LRB9002033THpk LRB9002033THpk 1 AN ACT relating to elementary and secondary education 2 funding. 3 Be it enacted by the People of the State of Illinois, 4 represented in the General Assembly: 5 Section 1. Short title. This Act may be cited as the 6 Fund Education First Act. 7 Section 5. Educational appropriations. Beginning with 8 fiscal year 1998 and in each fiscal year thereafter, subject 9 to the provisions of Section 10 of this Act, the General 10 Assembly shall appropriate for elementary and secondary 11 educational programs an amount that is equal to or exceeds 12 the sum of: (i) the total amount appropriated from general 13 funds revenues for elementary and secondary educational 14 programs during the fiscal year immediately preceding the 15 fiscal year for which the appropriation is being made; and 16 (ii) 50% of the growth in general funds revenues for the 17 fiscal year for which the appropriation is being made, when 18 comparing the general funds revenues estimated to be 19 available for that fiscal year with the general funds 20 revenues available for the immediately preceding fiscal year, 21 as determined by the Bureau of the Budget. 22 Section 10. Continued minimum funding level. Funding 23 for elementary and secondary educational programs shall 24 continue to be appropriated from general funds revenues 25 pursuant to the formula established in Section 5 until the 26 amount appropriated from general funds revenues for 27 elementary and secondary educational programs for a fiscal 28 year represents one-half of the total revenues available from 29 local, State, and federal sources for elementary and 30 secondary educational programs for that same fiscal year, as -2- LRB9002033THpk 1 estimated by the State Superintendent of Education. In each 2 subsequent fiscal year, the amount appropriated from general 3 funds revenues for elementary and secondary educational 4 programs shall be not less than the greater of the following 5 amounts: (i) the amount appropriated from general funds 6 revenues for those purposes during the first fiscal year 7 after the effective date of this Act when the amount so 8 appropriated represents at least one-half of the total 9 revenues available from local, State, and federal sources for 10 elementary and secondary educational programs for that same 11 fiscal year, or (ii) an amount that represents not less than 12 one-half of the total revenues available from local, State, 13 and federal sources for elementary and secondary educational 14 programs for that subsequent fiscal year, as estimated by the 15 State Superintendent of Education. 16 Section 15. Governor's budget. Beginning with fiscal 17 year 1999 and in each fiscal year thereafter, the Governor 18 shall include in his annual budget an allocation for 19 elementary and secondary education that conforms to the 20 provisions of this Act. 21 Section 99. Effective date. This Act takes effect upon 22 becoming law.
