LRB9002255WHdv LRB9002255WHdv 1 AN ACT to amend the Workers' Compensation Act by adding 2 Section 3.5. 3 Be it enacted by the People of the State of Illinois, 4 represented in the General Assembly: 5 Section 5. The Workers' Compensation Act is amended by 6 adding Section 3.5 as follows: 7 (820 ILCS 305/3.5 new) 8 Sec. 3.5. Alcohol or drugs. If, at the time of his or 9 her injury or disablement, an employee has an alcohol 10 concentration of 0.10 or more as defined in Section 11-501.2 11 of the Illinois Vehicle Code, cannabis, or a controlled 12 substance in his or her body and the alcohol, cannabis, or 13 controlled substance contributed to the accident or event 14 resulting in the injury, compensation under this Act shall be 15 denied.
