605 ILCS 5/4-101.17 new
Amends the Illinois Highway Code to provide that the
Department of Transportation has the power to create an
overpass to bypass an existing railroad-highway grade
crossing when the separation of a railroad-highway grade
crossing severely impairs the ability of emergency vehicles
to operate efficiently and effectively due to an above
average frequency and duration of interruptions to vehicular
traffic.

1 AN ACT to amend the Illinois Highway Code by changing
2 Section 4-101 and by adding Section 4-101.17.
3 Be it enacted by the People of the State of Illinois,
4 represented in the General Assembly:
5 Section 5. The Illinois Highway Code is amended by
6 changing Section 4-101 and by adding Section 4-101.17 as
7 follows:

9 Sec. 4-101.
10 The Department shall have the powers and duties stated in
11 Sections 4-101.1 to 4-101.17 4-101.16, inclusive.
