      30 ILCS 805/8.21 new
          Amends the  Illinois  Municipal  (IMRF)  Article  of  the
      Pension Code to make sworn police officers employed full time
      by   a   school  district  eligible  for  the  sheriff's  law
      enforcement employee formula.  Amends the State Mandates  Act
      to  require  implementation without reimbursement.  Effective
      immediately.

 1        AN ACT to amend the Illinois  Pension  Code  by  changing
 2    Section 7-109.3 and to amend the State Mandates Act.
 3        Be  it  enacted  by  the People of the State of Illinois,
 4    represented in the General Assembly:
 5        Section 5.  The  Illinois  Pension  Code  is  amended  by
 6    changing Section 7-109.3 as follows:
 7        (40 ILCS 5/7-109.3) (from Ch. 108 1/2, par. 7-109.3)
 8        Sec. 7-109.3.  "Sheriff's Law Enforcement Employees".
 9        (a)  "Sheriff's law enforcement employee" means:
10             (1)  A  county  sheriff and all deputies, other than
11        special deputies, employed on a full time  basis  in  the
12        office of the sheriff.
13             (2)  A person who has elected to participate in this
14        Fund  under  Section  3-109.1  of  this  Code, and who is
15        employed  by  a  participating  municipality  to  perform
16        police duties.
17             (3)  A law enforcement officer employed  on  a  full
18        time  basis  by a Forest Preserve District, provided that
19        such officer shall be deemed a "sheriff's law enforcement
20        employee" for the purposes of this Article,  and  service
21        in  that  capacity  shall  be  deemed  to be service as a
22        sheriff's law enforcement employee, only if the board  of
23        commissioners of the District have so elected by adoption
24        of  an affirmative resolution.  Such election, once made,
25        may not be rescinded.
26             (4)  A person not eligible to participate in a  fund
27        established  under Article 3 of this Code who is employed
28        on a full-time basis by a participating  municipality  or
29        participating instrumentality to perform police duties at
30        an  airport,  but  only if the governing authority of the
31        employer has approved sheriff's law enforcement  employee

 1        status for its airport police employees by adoption of an
 2        affirmative  resolution.   Such approval, once given, may
 3        not be rescinded.
 4        (5)  A  person  who  participates  in  the  Fund  and  is
 5    employed full time by a participating school  district  as  a
 6    sworn police officer.
 7        (b)  An  employee  who  is  a  sheriff's  law enforcement
 8    employee prior to the time for which he is  granted  military
 9    leave  or  authorized  leave of absence shall receive service
10    credit in that capacity. Sheriff's law enforcement  employees
11    shall  not  be  entitled to out of State service credit under
12    Section 7-139.

14        Section 10.  The State Mandates Act is amended by  adding
15    Section 8.19 as follows:
16        (30 ILCS 805/8.19 new)
17        Sec.  8.19.  Exempt  mandate.  Notwithstanding Sections 6
18    and 8 of this Act, no reimbursement by the State is  required
19    for  the  implementation  of  any  mandate  created  by  this
20    amendatory Act of 1995.
21        Section  99.  Effective date.  This Act takes effect upon
22    becoming law.
