      625 ILCS 5/11-601         from Ch. 95 1/2, par. 11-601
          Amends the Illinois Vehicle Code  to  raise  the  maximum
      speed  limit  outside  an urban area to 65 miles per hour for
      any second division vehicle designed or used for the carrying
      of a gross weight of 8,001 pounds or more, bus  (on  highways
      under the jurisdiction of the Department of Transportation or
      the  Illinois  State  Toll  Highway  Authority),  house  car,
      camper,  private  living  coach,  recreational  vehicle,  and
      vehicle  towing  any  other  vehicle.   Provides that a first
      division vehicle may exceed the posted speed limit outside an
      urban district by 10 miles per hour to overtake  and  pass  a
      second division vehicle.  Effective immediately.

 1        AN  ACT  to  amend  the Illinois Vehicle Code by changing
 2    Section 11-601.
 3        Be it enacted by the People of  the  State  of  Illinois,
 4    represented in the General Assembly:
 5        Section  5.   The  Illinois  Vehicle  Code  is amended by
 6    changing Section 11-601 as follows:
 7        (625 ILCS 5/11-601) (from Ch. 95 1/2, par. 11-601)
 8        Sec. 11-601.  General speed restrictions.
 9        (a)  No vehicle may be driven upon any  highway  of  this
10    State  at  a  speed  which  is greater than is reasonable and
11    proper with regard to traffic conditions and the use  of  the
12    highway,  or  endangers the safety of any person or property.
13    The fact that the speed of a  vehicle  does  not  exceed  the
14    applicable  maximum  speed  limit does not relieve the driver
15    from the duty to decrease speed when approaching and crossing
16    an intersection, approaching and going around a  curve,  when
17    approaching  a  hill crest, when traveling upon any narrow or
18    winding roadway, or when special hazard exists  with  respect
19    to  pedestrians  or  other traffic or by reason of weather or
20    highway conditions.   Speed  must  be  decreased  as  may  be
21    necessary to avoid colliding with any person or vehicle on or
22    entering  the  highway  in compliance with legal requirements
23    and the duty of all persons to use due care.
24        (b)  No person may drive a vehicle upon  any  highway  of
25    this  State  at  a speed which is greater than the applicable
26    statutory maximum speed limit established by paragraphs  (c),
27    (d),  (e),  (f) or (g) of this Section, by  Section 11-605 or
28    by a regulation or ordinance made under this Chapter.
29        (c)  Unless some other speed restriction  is  established
30    under  this  Chapter,  the  maximum  speed  limit in an urban
31    district for all vehicles is:

 1             1.  30 miles per hour; and
 2             2.  15 miles per hour in an alley.
 3        (d)  Unless some other speed restriction  is  established
 4    under  this Chapter, the maximum speed limit outside an urban
 5    district for any vehicle of the first division  or  a  second
 6    division vehicle designed or used for the carrying of a gross
 7    weight  of  8,000 pounds or less (including the weight of the
 8    vehicle and maximum load) is (1) 65 miles per  hour  (i)  for
 9    all  highways  under  the  jurisdiction of the Illinois State
10    Toll Highway Authority and (ii) for all or part  of  highways
11    that  are designated by the Department, have at least 4 lanes
12    of traffic, and have a separation between the roadways moving
13    in opposite directions and (2) 55  miles  per  hour  for  all
14    other highways, roads, and streets. However, a vehicle of the
15    first  division  may  exceed  the  maximum posted speed limit
16    outside an urban district by 10 miles per hour  in  order  to
17    overtake and pass a second division vehicle proceeding in the
18    same  direction,  overtaking  and passing to the left side of
19    the roadway and in  accordance  with  this  Code,  until  the
20    vehicle  of  the  first  division  is  safely  clear  of  the
21    overtaken  second division vehicle and is able to again drive
22    to the right side of the roadway.
23        (e)  (Blank).  Unless some lesser  speed  restriction  is
24    established  under  this  Chapter,  the  maximum  speed limit
25    outside an urban  district  for  a  second  division  vehicle
26    designed  or used for the carrying of a gross weight of 8,001
27    pounds or more (including  the  weight  of  the  vehicle  and
28    maximum load) is 55 miles per hour.
29        (f)  Unless  some  other speed restriction is established
30    under this Chapter, the maximum speed limit outside an  urban
31    district for a bus is:
32             1.  65  miles per hour upon any highway which has at
33        least 4 lanes of traffic and of which  the  roadways  for
34        traffic  moving in opposite directions are separated by a

 1        strip of ground which is not  surfaced  or  suitable  for
 2        vehicular  traffic,  except  that the maximum speed limit
 3        for a bus on all highways, roads, or  streets  not  under
 4        the  jurisdiction of the Department or the Illinois State
 5        Toll Highway Authority is 55 miles per hour; and
 6             2.  65 60 miles  per  hour  on  any  other  highway,
 7        except  that  the  maximum  speed  limit for a bus on all
 8        highways, roads, or streets not under the jurisdiction of
 9        the  Department  or  the  Illinois  State  Toll   Highway
10        Authority is 55 miles per hour.
11        (g)  Unless  some  other speed restriction is established
12    under this Chapter, the maximum speed limit outside an  urban
13    district  for  a  house  car,  camper,  private living coach,
14    vehicles licensed as recreational vehicles, and  any  vehicle
15    towing  any  other  vehicle  is  65  55 miles per hour or the
16    posted speed limit, whichever is less.

18        Section 99.  Effective date.  This Act takes effect  upon
19    becoming law.
