The Criminal Code of 1961 is amended by adding 6 Section 24-2.3 as follows: 7 (720 ILCS 5/24-2.3 new) 8 Sec. 24-2.3. Retail sale of firearms. 9 (a) A person may not sell firearms in this State unless 10 the person: 11 (1) operates from one or more fixed locations that 12 are zoned for commercial uses or are nonconforming uses 13 that have been continuously used as retail 14 establishments; and 15 (2) has a certificate of registration under Section 16 2a of the Retailers' Occupation Tax Act. 17 (b) Nothing in this Section prohibits an isolated or 18 occasional sale of a firearm by an individual. For purposes 19 of this Section, "isolated or occasional sale" is used as in 20 the Retailers' Occupation Tax Act. 21 (c) A person who violates this Section is guilty of a 22 Class A misdemeanor.
